(o) "Gross Revenue" Shall mean any and all compensafion in whatever form, exchange or otherwise derived by the "GRANTEE" from Subscribers for the provision of Cable Service, as defined in the Cable Act from the operatiori of the "Cable System° as defined within this Agreement and all other compensation derived from, but not limited to subleasing office space and equipment located in the Franchise area to non-affiliates, net local advertising sales and interest on subscriber deposits (unless such interest is return to the Subscriber). This term does not include any sales, excise or other taxes of fees collected by GRANTEE on behalf of any state, city or other governmental unit, and shall be net of bad debt, refunds to Subscribers and copyright fees. (p) "Mayor" Shall mean Chief Executive Officer of the City or any person to whom the Mayor designated the authority to act. (q) "Normal Service (ntervals" Shall mean the period between the time that the GRANTEE is notified by a Subscriber of the City of a service deficiency, the GRANTEE shall by (24) twenty-four hours following receipt of such deficiency notice, (thirty-two (32) hours when notice is received by GRANTEE prior to noon) commence correcting such deficiency; providing that the Subscriber or representative is available, during this period, at the premises or location to be serviced. Complaints received by the GRANTEE concerning partial or complete system outages affecting more than five (5) Subscribers shall be acted upon promptly and in no event more that (2) two hours after the GRANTEE becomes aware of the aforementioned outages. (r) "Peg Access Channel" Shall mean the channel or channels on which "Peg Access" programming is cablecast_ ? (s) "Peg Access EquipmenY" Shall mean equipment provided by the GRANTEE, which is necessary for the production and presentation of cablecast programs other than automated services, including technical assistance, and the GRANTEE shall permit its use for the production and presentation of public access programs to persons residing within the City of North Olmsted. (t) "Person" Shal1 mean any individual or association of individuals, or any firm, corporation partnership, government, or other business entity_ (u) "ReasonablQ Roquest" Shall mean a written request by the City, delivered to the GRANTEE via Certified U.S. Mail which request shafl, taking into account all relevant facts and circutnstances, be reasonable on its face.
