_.. ,, ,..:......, ??.?,?. <br />he or she shail prescribe concerning such location or installation. <br />(E) Whenever the Ciiy, County, or State of Ohio shall require the relocation or <br />reinstallation of any properiy of the GRANTEE in any of the Streets of the City, it shall <br />be the obligation of the GRANTEE upon forty-five (45) days (except in case of <br />emergency declared by the Mayor in which even such lesser notice as shall be <br />reasonable under the circumstances presented) written notice of such requirements to <br />remove and relocate or reinstall said property. Such relocation, removal or <br />reinstallation by the GRANTEE shall be at the sole cost of the GRANTEE. <br />(F) Except where othennrise provided by applicable law, in areas where both <br />telephone and electric utilities' facilities are above ground at the time of the installation <br />of the Cable System, the GRANTEE may install its facilities above ground. Whenever <br />in any place within the City both the electric and telephone utilities shall be located <br />underground, it shall be the obligation of the GRANTEE to locate or to cause its <br />property to be located underground. If the City provides parallel notice to telephone <br />and electric utility companies and any other cable system grantee requesting that <br />above-ground portions of their equipment be moved underground, the GRANTEE will <br />comply with all such reasonable requests by City, provided that such utilities and <br />other cable system grantee's do likewise. The City shall coordinate among the <br />GRANTEE, telephone and electric utility companies, other cable system grantees <br />and/or users of public rights-of-way to ensure that relocation is done in the most <br />economical and appropriate manner possible. lf the GRANTEE shall in any case be <br />unable for operational reasons only to locate or refocate any part of its property <br />underground, then in that event the Mayor, upon being satisfied as to the facts thereof, <br />may permit such property to remain above the ground even though other facilities may <br />be place underground in the area. However, any such permission shall be upon <br />such conditions as the Mayor may require for the public health and welfare. Any <br />facilities of the GRANTEE placed underground at the property owner's request, in an <br />area where electric or telephone facilities are aerial; shall be installed with the <br />addtional expense paid in advance by the property owner. <br />(G) GRANTEE shall have the authority to trim #rees or other vegetation upon <br />and overhanging Streets of the City so as to prevent the branches of such other <br />vegetation or trees from coming in contact with GRANTEE's wires, cables and other <br />structures. All trimming shall be done under the reasonable supervision and direction <br />of the City. <br />(H) In case of disturbance of any Street caused by the GRANTEE, the <br />GRANTEE shall, at its own cost and expense, and in a manner approved by the <br />Mayor, replace and restore such Street in as good a condition as before the work <br />involvinq such disturbance was done. <br />6
