CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96-87 <br />BY: Duane K. Limpert <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQUIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BY GARLAND L. <br />AND MARTHA L. HOGUE AND DESIGNATED AS PERMANENT <br />PARCEL NO. 235-16-01 BY CUYAHOGA COUNTY MAPS AND RECORDS, <br />SAID EASEMENT SHOWN ON EXHIIBTT "B" AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted and the Ohio Department of Transportation has <br />agreed to pay all costs and expense for the construction of the traffic control equipment with the <br />easement area as shown on the Exhibit "A", being part of the City-Wide "Closed Loop" Traffic <br />Signal System Project. <br />NOW THEREFORE, BE IT ORDAINED BY TBE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts an easement from Garland L. and Martha L. <br />Hogue for traffic control equipment, as shovcm on Exhibit "A". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause <br />said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby determined to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health and safety of the <br />City, and further provided it receives the affirmative vote of two-thirds of all members of Council, <br />it shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />fPASSED: <br />/TsT: <br />A <br />? <br />/ ?g-t?eu.BC <br />?- <br />Barbara L.
