GRANTEE shall comply at all times with all <br />other applicable Federal, State and Local laws and all Executive and Administrative <br />Orders relating to non-discrimination. <br />B. GRANTEE shall not refuse to hire or employ, nor bar or discharge from <br />employment, nor discriminate against any person in compensation or in terms, <br />conditions or privileges of employment because of age, race, creed, color, national <br />origin, or sex. GRANTEE shall strictly adhere to the Equal Employment Opportunity <br />requirements of the FCC as expressed in the Cable Act of 1992, and the Americans <br />with Disabilities Act, and as amended from time to time. <br />C. Except as otherwise required by the FCC Rules governing cable <br />operations, GRANTEE shall exercise no control over program content on any of the <br />access channels. <br />D. Liability for obscenity, defamation or invasion of privacy on any access <br />channels shall rest with the person, group of persons, or any organization or <br />corporation utilizing said access channels. <br />SECTION XVI: <br />CITY CABLE COORDINATOR <br />The City Cable Coordinator shall serve as the principal and primary <br />representative of the City. The GRANTEE will attend meetings with the coordinator at <br />his or her reasonable request relative to issues pertaining to this Agreement. <br />SECTION XVII: <br />FRANCHISE FEE AND OTHER COMPENSATION <br />A The GRANTEE shall set aside and pay the City a sum equal to (5%) five . <br />percent (which shall be decreased to such lower percent, as shall be paid by other <br />GRANTEES of cable television Franchises within the City) of the annual Gross <br />Revenues of the GRANTEE. The aforementioned payment shall be made to the City - <br />throughout the life of the Franchise. The GRANTEE shall file with the City within (45) <br />forty-five days after the expiration of each of the GRANTEE's fiscal quarters a revenue <br />statement containing a satisfactory and clear explanation, which shows in detail the <br />gross revenues of the GRANTEE during the proceeding quarter. If the Federal <br />Communications Commission (FCC), Congress or other governmental entity with <br />authority over multi-channel service ever allows a governmental entity or Issuing <br />Authority to increase the Franchise Fee beyond five (5%) percent, then the Issuing <br />25
