SECTION XXV: RIGHT TO EXTEND AGREEMENT The City reserves the right to unilaterally extend all terms and conditions of this franchise Agreement for a period of (1) one year (or such longer period as the City and GRANTEE shall mutually agree) beyond the expiration date of this Franchise Agreement. Should the City exercise such right, it shall notify the GRANTEE of its intent via Certified U.S. mail not less than (12) twelve months prior to the expiration date of the Franchise Agreement. The GRANTEE waives any and all rights to object to such an extension, providing the City notifies the GRANTEE (12) finrelve months prior to the expiration date of this Agreement. SECTION XXVI: RATES AND CHARGES A The GRANTEE shall establish initial rates and charges for services provided pursuant to this Agreement. The City hereby acknowledges that rates and charges for services may be regulated by State and/or Federal regulatory authorities. Should the rates and charges for any services not be regulated by State or Federal Authority, the City reserves the right and authority to reasonably regulate such other services to the extent permitted by law. In recognition of the economic challenges confronting senior citizens and others in the City, Grantee will offer Subscribers a Lifeline service, the content of which is described in Exhibit 3, attached hereto. SECTION XXVII: BILLING TO SUBSCRIBERS The GRANTEE shall detail the individual Subscribers aggregate monthly charge along with a clear description of the charges for service, programming, equipment and list all charges as separate items on the Subscribers monthly invoice. The GRANTEE shall provide a sample invoice along with a listing of GRANTEE's charges for each separate service containing such detail as may be required by the City. The GRANTEE shall provide to the City, such sample invoice within (15) calendar days prior to commencement of service to Subscribers. 34
