SECTION XXV: <br />RIGHT TO EXTEND AGREEMENT <br />The City reserves the right to unilaterally extend all terms and conditions of this <br />franchise Agreement for a period of (1) one year (or such longer period as the City and <br />GRANTEE shall mutually agree) beyond the expiration date of this Franchise <br />Agreement. Should the City exercise such right, it shall notify the GRANTEE of its intent <br />via Certified U.S. mail not less than (12) twelve months prior to the expiration date of <br />the Franchise Agreement. <br />The GRANTEE waives any and all rights to object to such an extension, <br />providing the City notifies the GRANTEE (12) finrelve months prior to the expiration date <br />of this Agreement. <br />SECTION XXVI: <br />RATES AND CHARGES <br />A The GRANTEE shall establish initial rates and charges for services <br />provided pursuant to this Agreement. The City hereby acknowledges that rates and <br />charges for services may be regulated by State and/or Federal regulatory authorities. <br />Should the rates and charges for any services not be regulated by State or Federal <br />Authority, the City reserves the right and authority to reasonably regulate such other <br />services to the extent permitted by law. In recognition of the economic challenges <br />confronting senior citizens and others in the City, Grantee will offer Subscribers a <br />Lifeline service, the content of which is described in Exhibit 3, attached hereto. <br />SECTION XXVII: <br />BILLING TO SUBSCRIBERS <br />The GRANTEE shall detail the individual Subscribers aggregate monthly charge <br />along with a clear description of the charges for service, programming, equipment <br />and list all charges as separate items on the Subscribers monthly invoice. The <br />GRANTEE shall provide a sample invoice along with a listing of GRANTEE's charges <br />for each separate service containing such detail as may be required by the City. <br />The GRANTEE shall provide to the City, such sample invoice within (15) <br />calendar days prior to commencement of service to Subscribers. <br />34
