ORDINANCE NO. 96 - 50 <br />BY• Councilmen Dean McKay and eorge Nasher <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO AN AGREEMENT WITH HOWARD, NEEDLES, <br />TAMMEN AND BERGENDOFF TO PROVIDE ENGINEERING SERVICES <br />PERTAINING TO REVISING THE SIDEWALK PLANS FOR A SEVEN FOOT WIDE <br />REINFORCED CONCRETE SIDEWALK ON THE WEST SIDE OF CROCKER ROAD <br />NORTH OF LORAIN ROAD FOR THE PROPOSED CROCKER-STEARNS ROAD IN <br />THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the services of the engineering firm of <br />Howard, Needles, Tammen & Bergendoff be hired to accomplish the aforesaid project due to <br />their expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby express <br />its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into a <br />Contract with Howard, Needles, Tammen & Bergendoff for the purpose of providing engineering <br />services pertaining to revising the sidewalk plans for a seven foot wide reinforced concrete <br />sidewalk on the west side of Crocker Road north of Lorain Road for the proposed Crocker- <br />Stearns Road in the City of North Olmsted. A copy of said Agreement is attached hereto and <br />made a part hereof and marked Exhibit "A". <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to proceed with the engineering services for this <br />project to stay within the schedule required by the County of Cuyahoga Deparhnent of <br />Development and further provided it receives the affirmative vote of two-thirds of all members <br />of Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor.
