<br />. • ??? <br />r, . . ?,- <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96-48 <br />BY: CDUNCILMAN NASHAR, COUNCILMAN LIMPERT, MAYOR BOYLE <br />AN ORDINANCE ADOPTING A NEW CHAPTER 761 OF <br />THE BUSINESS REGULATION CODE OF THE CITY OF <br />NORTH OLMSTED, ENT7TLED "ADULT <br />ENTERTAINMENT BUSINESSES, " AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, this Council has reviewed studies from various cities documenting the <br />negative secondary effects of Adult Entertainment Businesses upon residential neighborhoods; <br />and <br />WHEREAS, this Council believes that operating adult entertainment businesses within <br />close proximity of residences, churches, playgrounds, or schools would constitute a nuisance; <br />and <br />WHEREAS, this Council desires to regulate adult entertainment businesses located in <br />the City so as to prevent crime, protect retail trade, maintain property values, and generally <br />preserve and protect the quality of the residential neighborhoods in the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />(A) Pu=s?. It is the purpose of this ordinance to regulate adult entertainment <br />businesses in the City of North Olmsted to promote the health, safety, morals, and general <br />welfare of the citizens of the City. The provisions of this ordinance have neither the purpose <br />nor effect of imposing a limitation or restriction on the content of any communicative materials <br />or services, including adult entertainment. Similarly, it is not the intent nor effect of this <br />ordinance to restrict or deny access to adults to adult materials or services protected by the <br />First Amendment, or to deny access by the distributors and exhibitors of adult entertainment <br />to their intended market. Neither is it the intent nor effect of this ordinance to condone or <br />legitimize the distribution of obscene material or services.
