' <br />• . ? . .t.c.? ... <br />'?Fwa+, .r%?p„ <br /> <br />^Pmv/ <br />the showing of the female breast with less than a fully opaque covering of any part of the <br />nipple, or the showing of the covered male genitals in a discernible turgid state. <br />( fl"Person" means an individual, proprietorship, partnership, corporation, association, <br />or other legal entity. <br />(g) "Semi-nude" or "Semi-nude condition" means the showing of the female breast <br />below a horizontal line across the top of the areola at its highest point or the showing of the <br />male or female rear of the body which lies between two imaginary lines running parallel to the <br />ground when a person is standing, the first or top of such line drawn at the top of the cleavage <br />of the nates and second or bottom line drawn at the lowest visible point of the cleavage or the <br />lowest point of the curvature of the fleshy protuberance, whichever is lower, and between two <br />imaginary lines on ea.ch side of the body, which lines are perpendicular to the ground and to <br />the horizontal lines described above, and which perpendicular lines are drawn through the <br />point at which each nate meets the outer side of each leg. This definition shall not include any <br />portion of the cleavage of the human female breast, exhibited by a dress, blouse, skirt, leotard, <br />bathing suit, or other wearing appazel provided the areola is not exposed in whole or in part. <br />761.02. LICENSE REQUIRED. <br />(a) No person being the owner or operator of an adult entertainment business shall <br />permit said business to be opened, or continue to be opened, for public patronage without first <br />obtaining a license issued by the Director of Public Safety in accordance with the provisions of <br />this Chapter. If a person who wishes to operate an adult entertainment business is an <br />individual, the person must sign the application for a license as applicant. If a person who <br />wishes to operate such a business is other than an individual, each individual who has a 20 <br />percent or greater interest in the business must sign the application for a license as applicant. <br />Fach applicant must be qualified under this section and each applicant shall be considered a <br />licensee if a license is granted. <br />(b) Each owner or operator of an adult entertainment business shall pay the sum of <br />Five Hundred Dollazs ($500.00) per year for an annual license for such adult entertainment <br />business. A license shall not be renewed if grounds exist which would justify denying the <br />issuance of an original license. <br />(c) The license required herein shall not be transferable to any other person. <br />(d) No license shall be issued until an applica.tion, on a form approved by the City, is <br />submitted to the Director of Public Safety, which application shall, among other things, <br />contain the following information and be accompanied by the following documents: <br />2
