CITY OF NORTH OLMSTED ORDINANCE NO. 96- 47 By: Mayor Edward Boyle AN ORDINANCE EXTENDING THE EXISTING CABLEVISION OF THE MIDWEST, INC. FRANCHISE AGREEMENT WITH THE CITY OF NORTH OLMSTED FOR A PERIOD FROM FEBRUARY 15, 1996 UNTIL APRIL 15, 1996, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted has been negotiating for over one year with Cablevision of the Midwest, Inc. for an extension of the present franchise agreement providing cable television service to North Olmsted residents; and WHEREAS, both parkies wish to continue the negotiation process; and WHEREAS, the present franchise agreement is set to expire on February 15, 1996 and Cablevision of the Midwest, Inc. has agreed to an extension of the present franchise agreement until April 15, 1996, so as to continue the present negotiations beyond the impending expiration deadline. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Ciry of North Olmsted agrees to extend the present cable television franchise agreement with Cablevision of the Midwest, Inc. from February 15, 1996 until April 15, 1996, and that all terms and conditions included in the present franchise agreement shall remain and be in force until no later than April 15, 1996. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that the City wishes to continue negotiations for a renewal of the present franchise agreement while maintaining quality cable service, and provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passa,ge and approval by the Mayor.
