<br />Borrower o_z the date specified on Exlibit 1 as the "Resolution Date" (che capitalized terms not

<br />WITNESSETH
<br />WHE-REAS; the OWDA has been created, among other reason:;, to carry forward the
<br />declared pub'ic poli;;y of fhe State of Ohio to preserve, protect, upgrad'.., conserve, devcIop,
<br />utiUe and n:anage vhe wuter resources of the State, to prevent or abate the pollution of water
<br />resources, to, pramate the beneficial use ofwaters ofthe State for the proteation and
<br />preservation of the comfort, heaith, safety, convenience, and welfare, and the improvement of
<br />the econonu.- and general welfare and employment opportunities of and the creation of jobs for
<br />the people of t:he Stata, and to assist and cooperate with other governmental agencies in
<br />achieving su_'? purpases through the establishment, operation and maincenance ofwater
<br />development projec:s pursuant to Chapter 6121 ofthe Revised Code; and
<br />VVFU ,:ltE.4S, Title VI of the Clcan Water Act, as amended (the "CWA"), authorizes the
<br />Administrawr of the United States Environmental Protection Agency te make capitalization
<br />grants to sta';rs t+a establish a state water pollution contral rcvolving Ioan fund; and
<br />VVIiE:_ZEAS, pursuant to the CWA, states can provide laans and other types of financial
<br />assistance fru,n a wqtet pollution cantrol revolving loan fund to locai ccmmunities and
<br />intermuticip,al and ir.terstate agencies for the construction of gublicly-owned wastewater
<br />trcatment fac i'ities as defined in Section 212 of the CWA and for the implementation of nonpoint
<br />source pollution controi management pro$rams and development and implementation of pIans
<br />under the est-ary pr,.-)tection programs; and
<br />WHM REAS, the Ohio General Assembiy has created a water poltutian control loan fund
<br />("WPCLF°) pursuant xo Ohio Revised Code Section 6111.036 to provid:e loans and other types
<br />of financisl .ay,istance as set forth in said Section; and
<br />to assist the Director (whenever the term "birector" is used herein, svch
<br />term shall a]s.- be der:r.ied to include the Director's designated representative(s), if arty) in
<br />providing loans and other types of financial assistance from the WPCLF, and to assist in the
<br />administratio : and o?jeration of the WPCLF as authorized by the Ohio Revised Codc Sectian
<br />6111.036, thc Director ha5 entered into an Interagency Agreeme:?t with the OWDA, dated
<br />Sepcermber 30, 1995; and
