ARTICX,E II - PRp1'ERTY INTEREST IN PRQJECT SITE ArJD PROJECT FACILITIES ANb RIGHTS OF ACCESS THEIZETQ Secti-n 2.i, All real estate and interests in real estate and a11 personai property constituting yhe Prosyct Facilities and the Pro}ect Site shall be acquired by and shall be the property of tl: e H,ott o•Ner. Secti,in 2.2. rhe Borrower agrees that the State or its duly authorized agents shall have the right at ali reasonable times to enter upon the Project Site and Project Facilities and to examine and inspeet the same. The Borrower further agrees ihat the Stide or its designated representativi:s shall have such rights of access to the Project Sita and P_oject Facilities as may be reasonably neces:.ary to enable the OWDA ta exercise its rigas pursuant ta Section 5.8 hereof, ARTICLE. III -?':CQCfISITION OF PROTECT SITE, CONSTRUCTION OF PR4TECT FACTLITIES, AND PAYMENT OF COSTS THEREOF Section 3.1. SubjECt to the terms and conditions of this Agreemant, the Borrower shail do all ttungs neceEsaryr to construct the Froject Facilities on the Project Site (which the Botrower hereby represents has been a ?quired by the Borrower) by means of the construci:ion contract bids received on the date specified on Exhibit 1 as "Bid Operung." Sectiei 3.2. In connection with the construction of the Project Facilities, the Bonower agrees that: (a) It witl peoceed expeditiously with, and complete, the Frojej.t Facilities in accordance with the spec-:fic ter.ns and conditions of each of the following: the approved facilities plan, the Finding ofNo Signific-ant Lnpact, the approved project schedule, and the approved project detailed plans and sper.ifications, or umendments thereto as approved by the Directar. The 8orrower accepts such performaace as an essential element of this Agreement. (b) Tf,,a constnsction contract(s) will provide that the designated representatives of the Statp. will have acc::ss to the work whenever it is in preparation or progress and that the contractor wiil provide for sti(;h zcccss and inspection. (c) The construction af the Project Facilities an the Praject 5ite, including the Ietting of contracts in cDnnecdon thwrewith, will conform to applicable requirements of Federal, State and local Iaws, ord::uunces, rutes and regulations and will be performed ia compliance with all appiicable federai, state and local env€ronmentd daws and regulations in effect as of the date hereof. 5
