,.? .._ _ . jk, ?.- CITY OF NORTH OLMSTED ORDINANCE NO. 96-26 By: Councilman Dean McKay AN ORDINANCE TO AMEND CHAPTER 901 ENTITLED "EXCAVATIONS" OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED, OHIO, AS AMENDED BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, Ohio that: Section 1: Chapter 901 of the Codified Ordinances of the City of North Olmsted, Ohio, which now reads as follows: "901.01 PERMIT REQUIRED; FEE AND APPLICATION. (a) No person shall make any opening in any street, boulevard, avenue or public place in the City until such person has filed with the City Engineering Division a written or printed application setting forth and indicating there the location, kind and extent of the pavement desired to be removed, and the number, purpose and size of openings or excavations which are desired or necessary. The applicant shall pay a permit fee to the City in the amount of fifty dollars ($50.00) to the General Fund before the permit is issued and shall deposit with the City an additional amount sufficient to cover the cost of repairing or relaying and also the cost of materials needed for repairing or relaying the treelawn, roadway or paving removed or damaged as a result of the work done on or under the streets and public rights of way of the City, plus fifteen percent (15%) for the cost of inspection and general supervision, as shall be estimated by the Engineering Division of the City. (b) In the event that the street opening is commenced prior to the payment of the permit fee and deposit referred to in subsection (a) hereof, then the applicant shall pay a permit fee to the City in the amount of one hundred fifty dollars ($150.00) to the General Fund in addition to the deposit otherwise required in subsection (a) hereof. The City Engineer may issue a stop work order until such time as the permit fee and deposit money have been received by the City.
