,.? .._ _ <br />. jk, <br />?.- <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96-26 <br />By: Councilman Dean McKay <br />AN ORDINANCE TO AMEND CHAPTER 901 ENTITLED "EXCAVATIONS" <br />OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED, <br />OHIO, AS AMENDED <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, <br />Ohio that: <br />Section 1: Chapter 901 of the Codified Ordinances of the City of North Olmsted, <br />Ohio, which now reads as follows: <br />"901.01 PERMIT REQUIRED; FEE AND APPLICATION. <br />(a) No person shall make any opening in any street, boulevard, avenue or public <br />place in the City until such person has filed with the City Engineering Division a written <br />or printed application setting forth and indicating there the location, kind and extent of <br />the pavement desired to be removed, and the number, purpose and size of openings or <br />excavations which are desired or necessary. The applicant shall pay a permit fee to the <br />City in the amount of fifty dollars ($50.00) to the General Fund before the permit is <br />issued and shall deposit with the City an additional amount sufficient to cover the cost of <br />repairing or relaying and also the cost of materials needed for repairing or relaying the <br />treelawn, roadway or paving removed or damaged as a result of the work done on or <br />under the streets and public rights of way of the City, plus fifteen percent (15%) for the <br />cost of inspection and general supervision, as shall be estimated by the Engineering <br />Division of the City. <br />(b) In the event that the street opening is commenced prior to the payment of the <br />permit fee and deposit referred to in subsection (a) hereof, then the applicant shall pay a <br />permit fee to the City in the amount of one hundred fifty dollars ($150.00) to the General <br />Fund in addition to the deposit otherwise required in subsection (a) hereof. The City <br />Engineer may issue a stop work order until such time as the permit fee and deposit money <br />have been received by the City.
