.,._ ....,..,rp->-.. . .......:... . . . . ... . . .. . .. . ...._ ._., . ._._. . . „ _ .,.,..... .. ? ,.... .. .... ... .... ..... . . <br />i t <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96- 13 <br />BY• MaXor Ed Boyle <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO AN AGREEMENT WITH WESTERN RESERVE <br />ENGINEERING & SURVEYING COMPANY TO PROVIDE ENGINEERING <br />SERVICES FOR THE BROOKPARK CULVERT DRAINAGE STUDY AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Western Reserve Engineering & Surveying Company is currently under <br />contract for engineering services for the Georgette Relief Sewer Project and it has been <br />determined that the scope of services should be expanded to include a drainage study on the <br />Brookpark Culvert downstream of Georgette Avenue; and <br />WHEREAS, the Mayor has recommended that the services of the engineering firm of <br />Western Reserve Engineering & Surveying Co. be hired to accomplish the aforesaid services due <br />to their expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby express <br />its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement with Western Reserve Engineering & Surveying Company to provide engineering <br />services for the Brookpark Culvert Drainage Study. The fee for the drainage study shall be <br />$10,936.50. Western Reserve Engineering and Surveying Company shall credit the City of <br />North Olmsted in the amount of $8,508.39 as compensation for additional costs incurred by the <br />City of North Olmsted in the construction of the Clague Road Culvert over the Coe Ditch. The <br />additional costs were incurred as a result of inaccuracy in the plans for the culvert replacement <br />which were discovered during construction after the fee for the engineering services has already <br />been paid. A copy of said Agreement is attached hereto and made a part hereof and marked <br />Exhibit "A". <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to proceed with the engineering services for this <br />project and further providzd it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor.
