. ,__. ,...., <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96- 12 <br />BY: Mayor Ed Boyle and the Entire Council <br />AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH HOWARD, <br />NEEDLES, TA.MMEN AND BERGENDOFF TO PROVIDE ENGINEERING SERVICES <br />PERTAINING TO REMOVAL OF THE BIKE PATH FROM THE PLANS FOR THE <br />PROPOSED CROCKER-STEARNS ROAD IN THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the services of the engineering <br />firm of Howard, Needles, Tammen & Bergendoff be hired to accomplish the aforesaid project <br />due to their expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby express <br />its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into a <br />Contract with Howard, Needles, Tammen & Bergendoff for the purpose of providing engineering <br />services pertaining to removal of the bike path from the plans for the proposed Crocker-Stearns <br />Road in the City of North Olmsted. A copy of said Contract is attached hereto and made a part <br />hereof and marked Exhibit "A". <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to proceed with the plans and further that, <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor.
