- ._...z.. ,. ..?.... ???.? ...?.a.?...?,.,n?._,._mr <br /> <br />? <br />The Grantors hereby restrict said premises within the limits of the above described <br />easement against the construction thereon or above or subjacent thereto any buildings, <br />structures, improvements, tunnels, or facilities, of any kind, and the storing or placing <br />of any materials, equipment or other obstructions thereon, or excavation therein in any <br />manner interfering with said storm sewer and stormwater drainage channel and <br />appurtenances whatsoever, the access thereto, or the maintenance thereof, or otherwise <br />interfering therewith; provided that, notwithstanding the foregoing restrictions and <br />prohibitions, the Grantors may make any of the uses or do any of the things to the <br />foregoing premises with the express written consent of the Grantee. Such reserved and <br />permitted usage shall include, inter alia landscaping, within the regulations set forth in the <br />Codified Ordinances, and the maintenance thereof. <br />If the Grantors violate any of the provisions of this easement, the Grantee may enter <br />upon the premises to make such alterations as are necessary to bring the premises <br />into compliance with the provisions of this easement. Grantors shall fully use and enjoy <br />the aforesaid premises except as to the rights herein granted; and Grantee does hereby <br />agree to hold and save the said Grantors harmless for any and all damages, not caused by <br />the Grantors, arising from its use of the right-of-way easement and right-of-way herein <br />granted and agree to maintain, restore to its original or proper condition, and keep free <br />from nuisance, said right-of-way through the Grantee's use, occupation, and possession <br />of the rights herein granted.
