s ._ i ,a?.sz•`?,. <br />Ordinance No. 96-181 <br />Page 2 <br />929.02 SPECIAL PERMIT. <br />10H s <br />On any street served by an underground communications system, no transformer, <br />amplifier, junction box, pedestal or similar equipment shall be installed above the surface <br />of the ground on or adjacent to property zoned for residential use without the installer or <br />his authorized representative obtaining a pernut from the Service Director for such <br />installation. <br />The installer or his authorized representative shall submit an application to the <br />Service Director for the installation of such above ground device with a description of the <br />device, its dimensions, the abutting address at the proposed location, the location of the <br />device with respect to pavement, sidewalk or other items, and any other information <br />deemed necessary by the Service Director. If the Service Director determines that the <br />proposed installation may be detrimental to the public health, safety, or property values he <br />may refer the application for said installation to the City Council for review and approval. <br />If the application is approved by the Service Director or City Council, and upon payment <br />of the permit fee, the Service Director shall issue a pernut for the installation. <br />The fee for a new above-ground device shall be fifty dollars each ($50.00) and the <br />fee for a replacement above-ground device that is damaged, deteriorated or obsolete shall <br />be twenty five dollars each ($25.00). <br />The Service Director may order a damaged or deteriorated above-ground device <br />removed. Not more than thirty days shall be pernutted to remove an unacceptable above- <br />ground device. <br />929.99 PENALTY. <br />Whoever violates any provision of this Chapter is guilty of a minor misdemeanor. <br />Any such violation shall constitute a separate offense on each day during which a violation <br />occurs or continues."
