CITY OF NORTH OLMSTED ORDINANCE NO. 96 - 146 BY: Duane K. Limpert AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQiJIPMENT EASEMENT LOCATED ON PROPERTY OWNED BY NORTH OLMSTED ASSOCIATES AND DESIGNAT'ED AS PERMANENT PARCEL NO. 235-3-3, 11,12 BY CUYAHOGA COLTNTY MAPS AND RECORDS. SAID EASEMENT SHOWN ON EXHIBIT "B" AND, AUTHORIZING TIiE PAYMENT TO NORTH OLMSTED ASSOCIATES OF $908.00 FOR SAID EASEMENT AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted and the Ohio Department of Transportation has agreed to pay a11 costs and eapense for the construction of the traffic control equipment with the easement area as shown on the Exhibit "A", being part of the City-Wide "Closed Loop" Traffic Signal System Project. The City of North Olmsted cost is for adjustment required in the owners building sign because of the traffic control equipment location. NOW TfiEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. SECTION 1: That the City hereby accepts an easement from North Olmsted Associates for traffic control equipment, as shown on Exhibit "A" and authorizing the payment of $908.00 to North Olmsted Associates. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Recorder. The Finance Director is hereby directed to make a payment to North Olmsted Associates in the amount of $908.00. SECTION 3: That this Ordinance is hereby deternuned to be an emergency measure necessary for the immediate preservation of the public peace, property, health and safety of the City, and fiuther provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force imme 'ately upon its passage and approval by the Mayor.
