FRANCHISE AGREEMENT WITH <br />THE CITY OF NORTH OLMSTED FOR A PERIOD FROM <br />AUGUST l, 1996 LJNTIL OCTOBER 3, 1996, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted has been negotiating for over one year <br />with Cablevision of the Midwest, Inc. for an extension of the present franchise agreement <br />providing cable television service to North Olmsted residents; and <br />WHEREAS, both parties wish to continue the negotiation process; and <br />WHEREAS, the present franchise agreement is set to expire on August 1, 1996 <br />and Cablevision of the Midwest, Inc. has agreed to an extension of the present franchise <br />agreement until October 3, 1996, so as to continue the present negotiations beyond the <br />impending expiration deadline. <br />NOW, TBEREFORE, BE IT ORDAINED BY TBE COUNCIL OF TBE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted agrees to extend the present cable <br />television franchise agreement with Cablevision of the Midwest, Inc. from August 1, 1996 <br />until October 3, 1996, and that all terms and conditions included in the present franchise <br />agreement shall remain and be in force until no later than October 3, 1996. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for <br />the further reason that the City wishes to continue negotiations for a renewal of the <br />present franchise agreement while maintaining quality cable service, and provided that it <br />receives the affirmative vote of two-thirds of all members of Cou.ncil, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor.
