<br />BY: Duane K. Limpert <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96 - 115 <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQiJIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BY JOSEPH T. AND <br />MARILYN C. MALICKI AND DESIGNATED AS PERMANENT PARCEL <br />NO 235-19-01 BY CiTYAHOGA COUNTY MAPS AND RECORDS, SAID <br />EASEMENT SHOWN ON EXHIBIT "B" AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted and the Ohio Department of Transportation has agreed <br />to pay all costs and expense for the construction of the traffic control equipment with the easement area as <br />shown on the Exhibit "A", being part of the City-Wide "Closed Loop" Traffic Signal System Project. <br />NOW TIiEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. <br />SECTION 1: That the City hereby accepts an easement from Joseph T. and Marilyn C. <br />Malicki for traffic control equipment, as shown on Exhibit "A". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said <br />easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby deternuned to be an emergency measure necessary <br />for the immediate preservation of the public peace, property, health and safety of the City, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force imme 'ately upon its passage and approval by the Mayor. <br />PASSED: ! 7/ /CjQ (1 <br />TEST: „ <br />? <br />Barbara L.
