`rY CITY OF NORTH OLMSTED ORDINANCE NO. 96-109 BY: Mayor Ed Bo ?le ? .,+ AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH POLYTECH, INC. TO PROVIDE CONSTRUCTION OBSERVATION SERVICES FOR THE CLAGUE PARK SANITARY SEWER RETENTION IMPROVEMENT PROJECT, AND DECLARING AN EMERGENCY. WHEREAS, the City has received a grant from the Ohio Public Works Commission for the Clague Park Sanitary Retention System and one of the conditions of the grant is that the City contract with a Minority Business Enterprise (MBE) firm for various engineering services; and WHEREAS, the Mayor has recommended that the services of the MBE engineering firm of Polytech, Inc. be hired to accomplish the aforesaid services due to their expertise in this field; and WHEREAS, upon the recommendation of the Mayor, this Council does hereby express its desire to have the Mayor enter into a contract with said firm for and on behalf of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an Agreement with Polytech Inc., to provide construction observation services for the Clague Park Sanitary Sewer Retention Improvement Project. A copy of said Agreement is attached hereto and made a part hereof and marked Exhibit "A". SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to proceed with the engineering services for this project and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. __wmI— --, a_11_. ... , _,_?_
