<br />? <br />AGREEMENT TO P HA E R AI pR P RTY <br />This Agreement, entered into at North Olmsted, Ohio this day of , 1996 <br />by and between the City ofNorth Olmsted (hereinafter, the "Seller"), and Ida Juhasz (hereinafter <br />the "Purchaser"). <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located at 4881 Porter Road, North Olmsted, Ohio, Permanent Parcel <br />#232-9-40, which shall become part of the right-of-way in connection with the proposed widening <br />of Mill Road. <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />ITEM ONE: Purchase and Sale of Reat Proper <br />Subject to the terms and conditions of this Agreement, the Seller agrees to sell and the <br />Purchaser agrees to purchase all of the Seller's right, title and interest in the above-mentioned part <br />of the real property, which is located at 4881 Porter Road, North Olmsted, Ohio. The real <br />properry being sold is a ten foot (10') wide strip of land fronting on Mill Road, and legally <br />described in attached Exhibit "A". In addition, Seller agrees that she shall fully cooperate with the <br />City and do all acts necessary in the splitting off of said ten foot (10') strip from her property at <br />4881 Porter Road, including, but not limited to, signing the necessary subdivision plat or plats. <br />?T'EM TWO: Grant of Right of Entrv Construction Easement <br />Subject also to the terms and conditions of this Agreement, Seller further agrees to grant <br />Purchaser a Right of Entry-Construction Easement in substantially the form as the attached <br />EXHIBIT "B"
