<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 96-96 <br />BY: Duane K. Limpert <br />AN ORDINANCE ACCEPTIlVG A TRAFFIC CONTROL EQUIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BY FRANCHISE OPERATIONS, <br />INC. AND DESIGNATED AS PERMANENT PARCEL NO. 232-33-20 BY <br />CUYAHOGA COUNTY MAPS AND RECORDS, SAID EASEMENT SHOWN ON <br />EXHIBTT "B" AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted and the Ohio Department of Transportation has <br />agreetl to pay all costs and expense for the construction of the traffic control equipment with the <br />easement area as shown on the ExMbit "A", being part of the City-Wide "Closed Loop" Traffic <br />Signal System Project. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF TBE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts an easement from Franchise Operations, Inc. <br />for traffic control equipment, as shown on Exhibit "A". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause <br />said easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby deternvned to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health and safety of the <br />City, and further provided it receives the affirmative vote of twathirds of all members of Council, <br />it shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: !r, <br />L.
