,- . <br />. . ,,.. ,. <br />Ordinance 96- 93 <br />Page 3 <br />? <br />(d) Whoever violates this section is guilty of criminal trespass, a misdemeanor of the <br />fourth degree, except whoever violates subsection (a)(5) hereof is guilty of a minor misdemeanor. <br />(e) As used in this section, "land or premises" includes any land, building, structure <br />or place belonging to, controlled by or in custody of another, and any separate enclosure or room, <br />or portion thereof. (ORC 2911.21) <br />SECTION 2: That any Ordinance or parts of Ordinances inconsistent with or in conflict <br />with this Ordinance be, to the extent of any such inconsistency or conflict, and hereby are <br />repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfaze and for the <br />further reason it is immediately necessary to enact this legislation in order to better provide for <br />the property rights of property owners located in the City of North Olmsted, and to better provide <br />for the safety of youths engaging in skate boarding on private property, and further provided that <br />it receives an affirmative vote of two-thirds of a11 members of Council, it sha11 take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />PASSED ?
