G I?'Y OF NORTH QI,MSTED <br />ORDINANCE <br />jBy <br />AN QRDINANCE IMNDING ARTICLE III$ SECTION 9 dF f.RDIIti?ANCE <br />2445s ENTITLED "ZQ-NING (JEDINANCE OF THE CITY tF N((}?RTH (?LMSfiED" <br />ENACTED MCH 19s 1957 s AND DECLARIATG AN EMMGENCY. <br />WfiEREASp Cauncil has determined it necessary that in all new. <br />Subdivisions that developers at the time that the proposed plot plan of <br />said development is approved for fiLi.ng for record purposes anl,ys that <br />there be datermiried the approx3mate cost for the fint.shed gradirig of all <br />proposed sublots in said subdivision to a grade satisfactory to the City <br />Engineer and that at the time of approval of said plot plan of said pro- <br />posed subdivision that to secure the performance of sueh finished grading <br />to meet tha requisements of tYe City Engineer,, t'riat the deveZoger post as <br />security for such performance a Bond., and <br />VUUMS9 it is "ouncills opiniQn that such a perfarmance bond <br />for such finished grading will vary because of topographical conditions <br />and the size of the propnyed subdivision, that said bond will be in the <br />amount as recommencled by the City Engineer but not to exceed the su.ri of <br />Fifty Dollars (050.00) Per each sublot within said subdivision. <br />NEW, THEREFOREs BE IT (}RDAIZ'ED by the Cviancil af the City of <br />North Olmsted., State of OYiio: <br />Section l: Ti1at Article I1Ii Section 9 of Ordinance 2!t45s enacted <br />March 19, 1957, being entitled, nZoning Ordi.nanoe of City of North 07m tedit <br />be amended by adding subsection (a) to read as foLloxs: <br />Sec 9. (a) Tnat frm and after the effective date of this tlydinance <br />developers of subdivisions presenting pl.ats of said propased subdivisions <br />for development within the City, shall be requ3.red prior to t,he approval <br />of aaid pZat for record purposes anlys post a bond in an amount to be fixed <br />by the t%ity Enginser to insure the finished grade of a1Z Zots within said <br />proposed subdivision to the requ3xements established by the City Enginser <br />for the proper drainage and dsvelopment of said subdivision., and which said <br />bond for this purpose ahall be in the amaunt as recommnded by the City Engineer <br />but not to exceed the sum of 350,00, per lot for each sublot w:ithan said subdivision <br />and which req.uirement wiZl necessitate the submission by the developer at the time <br />of presenting said pZat for approval for record purposes onl.y,, of the praposed <br />improvement plans for said subdivision which improvement plart will meat the requ3.re- <br />ments of the ordinanees and resolutzons of this City., and, further., that f_or sub- <br />diviszons heretofore approvea by Council for record purposes only, and in which <br />subdivisions no work has been commeneed for the installation of the improvements <br />therein required, of the buildixg permit for the irnprovement of sublots within <br />said subdivision have baen issued, or, if ?ssued, no furthsr bv.ilding perrnit shaZ 1 <br />issu.e until the developers thereof post the necessary bond 3.n the atnounts as hAre- <br />inbefore provided to secure the performance of.' the finished grade as heretofore <br />established. <br />Section 2: This this ordinance is hereby deelared to be an emergency <br />measure aed sueh emergency exists bq virtwe of the necessity of immediately maki.ng <br />it nectessary that developers of subdivisions; uniformly establ3.sh a finished grade <br />throughout a subdivision to the sati?faction of the City Engineer eliminating the <br />various serious grade and drai.nage problems -qhich have heretofore been found to <br />exist. <br />Section 3: 'h'h.erefore, <br />and after 'ts passage, other?lisop <br />PA.SS • -??=• ?2 C? 196 0 <br />Bruce MacDonalds Pres. of auncil <br />this ordinance shall take immediats effect from <br />at the earliest period allowed bur law. <br />ATTEST: <br /> <br />
