7he Conatruct3.on Fund (1) shall consist of the partion of the proceeds a#° <br />the Improvement Bonda provided for in the following sectian and such additional <br />amounts as may be gaid into said fund by the Municipality, (2) shall be main- <br />tained by the Municipality in a deposit account fu11y secured by obligations <br />of the United States, but, until required for the purposes herein provided, <br />may be invested by the Fiscal Officer in bonds, notes or bills of the United <br />States maturing in not more tha,n one year from date of investment, (3) shall <br />be applied to the purposes for which the proceeds of the Improvement Bonds are <br />required to be used under Seetion l of this Oxdinanceo <br />I,nterest on any moneys or investments in each Fund shall be credited to <br />such Fund. <br />3ection 5. Allacation of Proceeds of Txnprovement Bonds -- The proceeds from <br />sale of tYze Improvement Bo d shall be allocatecl and are hereby appropriated to <br />the following funds Qf the Utility hereinabove established: (a) a sum equal to <br />the amount of interest which wi11 accrue on the Tmprovement Bonds to June 1, <br />1962, to the Debt Service Fund; (b) the portion, if any, representing premium, <br />to the Debt Service Reaerve Furrd; and (c) the entire balance of such proceeds, <br />to the Construction Fund. 731e Fiscal Offieer ia hereby authorized forthwith <br />upon receipt of such proceeds, to pay from the Construction Fun.d all bills <br />incwrred in coninection with the sa1e, issuance and delivery of said bonds, <br />incl.uding those rendexed by the Fiscal Agent, bond counsel and bond printers <br />urider employment agreements theretofore authorized. <br />Section 6. Additiazzal Bpnds -- The Municipality sha.ll have the right <br />from time to time to issue Adclitional Bonds for the purpose of inaking replace- <br />ments, extensions and improvements to the Utility, which Additional. Bonds shall <br />be payable from the Debt Ssrvice Fund and Debt Service Reserve Fund and be <br />secured by a lien upon the properties and revenues of the Utility on a parity <br />with the Improvement Bonds, and the Trustee shall authenticate and delivex° such <br />Addit3.ona], Bonds; pxovided, that, when an,y such Additional Bonds axe issued, <br />the Municipali,ty shall have furnished to the Trustee the following certificates; <br />(A) Certificate of Fisca]. Offieer and Lega1 Officer of the <br />Municipality certifying that, to the best of their knowledge, <br />the Municipality is not, on the c'tate of issue of such Additional <br />Bonds, in default in the performance of ary of its covenants <br />provided in this Ordinance, in the Mortgage or in the Bonds; <br />(B) Certifi.cate af an independent engineer satisfactory to the Trustee <br />showing (1) that said Additional Bonds are necessary to provide <br />rep].acements, extens3ons or improvements to the Utility which are <br />reasonably necessary for the proper and economical opera,tion of <br />the Utility or for meeting existing or prospective demaxids for <br />its services, or both, and (2) that the revenues of the Utility <br />received during arrW eighteen consecutive months of the <br />twenty,four calendar months preceding the sale of such <br />28 <br /> <br />
