<br />Co, is surety, which bond bears No. 601059, and
<br />WHSRW, said road has not, in the op3ni.on of the Ergineer and
<br />Couneil, been completed in conformity with the plans and specifications here-
<br />tofore approved by -th7.s Council for said improvemen:tj, and
<br />t?`rIEREAS, after considerabl:g negatiations between the City,, I4onson-

<br />Williams Go.., and rl'he Great Atnerican Indemni.ty Ca., as surety., a settZement has
<br />been eonsumrnated by which The Great American Indemnity Co. wi71 pay ta the City,
<br />its draft representing the gresent estimated cost of completing said improvement
<br />to meet the speczfications with the City doing a certain portion of the work to
<br />permit the said completion,

<br />deemed by the Lngineer, suf'ficient to permit the completion axbd correctivn of
<br />Maria 2,ane to mee-t the requirements of the ordinances of the City of North 0].mted
<br />for the construetion of stareets appl3.cabls at the time of said improvement, that
<br />Council based upon said report., does hereby xelease the Great American Indemz;i.ty
<br />Co, Bond Na. 601059 deposited by Monson-TdilLiams Co, with the City, as surety,
<br />for tha constructi.on of 11aria Lane paving.
<br />Section 2: 1,4herefore., this resvlution is hsreby declared to be an
<br />emargency measure and such amergancy e:ists by virtus of the necessity- of
<br />complstirig the negot3atiQn for the settlsment of the dispute over tha construction
<br />of Tflaria Lan.e and permitting whi.le weather perm:its, the correction and conpletion
<br />of the paving of 14aria l,ane in accordance with the plans and speci.fica-tions here-
<br />tofore approved by the City tlzereby psrmi.tting the prompt accsptanee of said street
<br />for dedication thereby protecting the residents and owners of property on said
<br />street.
