<br />OxnlTsANcE No. %J'Q E 3 <br />Td LEVY REVISED SPPCSA.L ASSESSMCNTS TC PE1'Y ADDITI:OlVAL COSTS <br />PRELIMINARX TO THE COPdSTRUCTTON OF A MUNICIPAL SEWERAGr <br />SYS-TEM FOR THE CITY OF NORrnH pIMSmED BY AMENDING SECTION 1 OF <br />0_RDINANCE No. 3015, ANI3 D2REC'I'ING REFtTND OF CASH QVER PAXNL;NI'S. <br />WHEREAS, pursuant to Ordinance No. 2992 passed February 16, 1960 and <br />subsequent legislatipn and instructions of Council, the corisulting enginee:rs for <br />the City prepared and filed with the C1erk af Council on Jizne 28, 1960, Ek revised <br />and corrected Iist of tentative assessments designed to provide an estimated sum <br />of $136,745.46 to pay additional costs preliminary to the c.onstruction of a municipa1. <br />sewexage system for the City, notice of which filing an.d oj' hearing thereon has beea ?- <br />duly published as required by Section 727.311 of the Revised Code of Ohio; and <br />WHERF;AS, on this date, a n.ew hearing upon said assessments was he]_c3 by <br />this council at which complaints and objections of aZl pro.perty owners appearirig <br />thereat were heard, r.onsidered and overruZec3; and <br />WHEREAS, n,umerous property owners have pa:td in cash assessments as ariginax,.y <br />levied by Ordinance No. 3015 and in revising and carrecting the tentative assessme?it <br />list, reductions in individual assessments require that resulting over payments be <br />now refunded to such praperty owners; <br />NOW,, THEREFORE, 3E T`T' ()RDAINED BY THF; COLINCII: OF TIE CITY OI?+' N()RT?I Oi,t?JS''l rxTC;• <br />Section 1. That Section. 1_ of Crdinance No. 3015 be and it i.s hei•eby amende(: <br />to read a s f'ollows ; <br />"Section l. `I'hat tne revised detailed assessxrient prepared as <br />hereinbefore recited to provide the sum deemed nECessary to pa;y i,he <br />additional costs of general and d.etai7_ed plans, ,specifications, <br />estimates of cost, preparation of tentative assessments and the <br />cost of f'inancing and legal services incidental to the preparation <br />of said plans and af a plan of financing the proposed construction of <br />a sewerage system far the City as described in 0rdinance No. 2992 <br />determining the necessit,y thereof, which detailed assessment amourits <br />in the aggregate to t136,71+5.46 and is evidenced by the list of assess- <br />ments filed as hereinbefore recited and thereafter conszdered and approved <br />by this council, be and the saxne is hereby adopted and conf'irmed; and <br />that there be and are hereby 1.evied and assessed upon the lotu and lands <br />listed in said revised detailed assessment la.st ,and comprised of a1l :l.ot?> <br />and lands lying within the present corpoxate boundaries of the C'ity of° <br />NortYl Olmsted, the several amounts reported in said detailed as..essmexat, <br />which assessments and the description of said lats an,d J_and.s are: now <br />on file in the offiee of the Clerk of Cauncil, are Zevied in acc:o.rdancE <br />with tax valuata,on and are in proportion to the special benefits derived <br />ancl are not in excesa of any statutory )..imitation.
