<br />Service Director to affer the sum of Two Thousand Dollaxs (42$OQ0.00) for the
<br />purchase of the easterly 50 feet of Permanent Parcel No. 237-11-16 on Summerland
<br />Avenue far sewer purposes, and
<br />WFiERT',,AS, since the submission of said offer the owner of a port:ion of
<br />Permatzent Paxcel No. 237-11-16 taill not sell for said consideration, but wants
<br />Twenty-Two Hundred Dollars ($2,200.00) for said parcel of land and that tne city
<br />sha.tl pay the title char;es and one-half of the escrow fee to permit the completion
<br />of said transaction,
<br />NOW, THEREFt1RE, BE I`1' URDAINL'D by the Ccruncil of the City of Iv7orth Ulmsted,
<br />State of Uhio:
<br />Section lt That Section 1 of Urdinance 3057, enacted June 21t 1960,

<br />"Section 1: That the Service Director is he-reby ordered and di.rected te
<br />offer to purchase Perm:anent I'arcel No. 237-11-16 on Summerland Avenue, in, the Czty
<br />of North 0lmsted, for sewer purposes for the sum of Two Thousand Dollaxs {32p000.<}0)'",
<br />be amended to read as follows:
<br />Section 1: That the Service Director is hereby ordered and di7°ected ta
<br />offer to purcha,se the easterly 50 feet of Permanent Parcel No. 237-11-16 on
<br />Summerland Avenue in the City of North OZmsted for sewer purposes, vnd a:3 consider-
<br />ation for the acquisition of said errcanent arcel to pay to the owner thereof ths
<br />sum of ?i'wenty-1'wo Hundred Dollars ?62,200.00?, plus the assumption of the cost of
<br />securing a Title Guarantee in favor of the city in the alriount of a2,200.00 and to
<br />pay one-ha.lf the cost of the escrow and the cost of filing the deed fox :record. The
<br />escrow a,gent selected by the seller is the North Olmsted Branch of ri'he Yational City
<br />Bank. Taxes on said premises are to be prorated a,s of the date of transfer and as
<br />said parcel of land is unimproved there are no further praratians to be zncurred.
<br />The seller is -Eo place upon sai.d deed $2.75 of documentazy stamps, xepresenting the
<br />consideration paid for said premises. The seller shall pay one-half of the escrow
<br />charges and shal.l secure a release of mortgage on the premises to be herein conveyed,
<br />if required. The seller is likewise to pay any commission due any realtor or broker
<br />effectuating the sa,le off' said prer.iises to the city.
<br />Section 21 Tha,t this ordinance is hereby declaxed to be an emergency
<br />measure and such emergency exists by virtue of the necessity of the city's sewer
<br />system and that said outright purcha,se a,s set foxth in 5ection 1 hereaf is the most
<br />economical and expedient method of' securing said necessary easement, whi.ch is aeter.-
<br />mined to be for the preser.vatian of the health, safety and general welfaxe of -the rity.
<br />Section 3s Wherefore, this ordinance shall take immediate eff'ect from axzcl
<br />a,fter its p4ssage, otherwise, 4t the eaxliest period allowed by law.
