CITY OF NORTH ULMSTED <br />ORDINANCE 14U.?36,6 G=? <br />By <br />t <br />ORDINANCE ANTENDING ARTICLE III OF URDINANCE 241+5, MACTJO 14ARCH <br />19, 1957, MITLED "COMPRF]HENSIVE ZONING ORllI1VAtVCE OF THE CITY <br />OF NORTH OL19STED"9 AND DECLARIPdG AN EMERGENCY. <br />WHh;REAS, Article III of Ordinance 2445 gertai.ns to the dedication of streetw <br />and the platting of allotments in the t;ity of North Olmsted, and <br />W!HklHEAS, pursuant to the installation of the improvements provieled for in <br />said article to be installed in subdivisions insofar as they relate to arE:as therein <br />designated to be used for future street purposes, it is the belief of CourLCil tha,t <br />adequate protection should be afforded the city ta insure the proper grada.ng withir <br />said subdivisions, and <br />WHEREAS, under the ordinances of this city it is now prerequisi-?,e fox <br />developers in new subdivisions to install paved streets, t;ha.t additional security <br />be given to the city to insure the completion of the grading as required by improve- <br />ment plans found acceptable to the city and to insure the cleaning up of the street <br />and the cleaning out of catch basins and storra sewers witri.in said subdivisions when <br />construction within said subdivisions has been substantial.ly completed and the street <br />found ready for presentation to the city for dedication, <br />NOWt 1FiLR;EFQFtE, BE IP ORDASNED by the Council of the City of tio:rth Olmstea, <br />State of Uhio: <br />Section 1: That Article III of Qrdinance 2445, enacted NTarch la, 1957, <br />entitled "Comprehensive Zoning Ordinance of the Ci.ty of North 4lmsted" be and is <br />hereby amended to read as follows to include Secti.on 12s <br />Section 12: Tha.t at the time an allotter or subdivider presents a plat ta <br />Council for acceptance for record purposes only camplying with all of the req_uirements <br />of Article III of Ord.in.ance 241+5 and am.endments thereto, ;said allotter be required to <br />post an i.ndemnifying bond insuring the city that said allotter or subdivider will <br />complete a,ll necessary grading as required by the improvement plans for said a11ot- <br />ment or subdivision accepted by the city, which bond wi11 be in an amount fixed by <br />Council to insure the completion of said grading and to a+3equately provid.e for the <br />cleaning up of proposed streets within said allotment or subdivision and the cleaning <br />out of catch basins and storm sewers constructed therein by said allotter or sub- <br />divider from all dir.t and refuse contained therein by virtue of construction on lands <br />abutting said proposed street. Said bond shall range in an amou.nt as fix:ed by Couric,i.l <br />upon the recommendation of the h?igineer, but shall not be less than `T'went;y Dollars <br />($20.00) in value for each sublot contained within said proposed subdivision nor rnoxe <br />than Fifty vollars (:a50.00) for each sublot in said pro.}osed subdivision. Tne pena.:t <br />provisions indemifying the city sha.ll be for the above purposes and in i,he form :znct <br />amount as Council may approve and with such sureties a,s approved by the Rayor. <br />Section 2: That this ordinance is hereby decla,red to be an emE;rgency measure, <br />necessary for the immediate preservation of the public he.alth, safety and ?;eneral tirel`'art <br />of the City of North Olmsted, a.nd such emergency exists b?y virtue of the ordinances of <br />this city now imposing the oblit;ation on an allotter or subdivider to construct a11 <br />of the improvements reouired in Article III of Ordinance 241+5, with the exception of <br />sidewalks, before ar?y building permit may be issued in said subdivision and i;he provisiox <br />herein are imminent to the health, safety and welfare of this city.
