<br />DECLARING AN EMERGEi3CY.
<br />NOW, THEREFQKE, BE Im I2ESOLVa By the Council of the City of North Olmsted,
<br />State of Ohio, three-fourths of all members elected thereto concurri.ng:
<br />5ection i: That it is deemed necessary a,nd conducive to the public heali;h,
<br />convenience and welfare that the southerly side of Lorain Road from Whitethorn A,venue
<br />easterly to the shogping center roadwa,y or parking lot be improved by constructing
<br />and installing a five foot concrete public sidewalk therein, in accordance with the
<br />plans and specifications prepaxed by the City Engineer.
<br />Section 2: That the grade of the street shall be the grade shown on the
<br />plans and specifications for said i.mprovement, which said g-rade and elevations are
<br />hereby confirmed and established as the grade of said street.
<br />Section 3: That the plans, specifications, estimate$ and profiles of the
<br />proposed i.mprovement, heretofore prepared by the City Engineer and naw filed in the
<br />office of the Director of Public Service, be and the same are hereby approved.
<br />Section 4: That the cost of said improvement shall be assessed by the foot
<br />front upon the following described lots and lands, to wit: all lots and lands bounding
<br />and abutti.ng upon the proposed i.mprovement, which said lotg and lands are hereby deter-
<br />mi.ned to be specia.lly ben.efited by said improvement; and the cost of said improvement
<br />shall include the expense of preliminary and other surveys, of printing and publish:ing
<br />the notice$, resolutions and ordinances required, the serving of said notices, the
<br />cost of constnzction, together with i.nterest on notes or bonds issued in anticipatio?n
<br />of collection of deferred assessments an d a11 other necessary expenditures.
<br />Section 5: That the assessments to be so levied sha11 be paid in ten annua,l
<br />installments, wi.th interest nat to exceed six percent per annum on deferred payments,
<br />provided tha,t the owner of a.n,y property assessed ma.,y, at his option, pay such asses:>-
<br />ment i.n cash within thirty days from and after the passage of the assessing ordinance,
<br />in which case said assessment shall not include any item of interest upon notes or
<br />bonds to be issued in anticipation of the collection of deferred installments of
<br />assessments.
<br />Section 6: That notes or bonds of the City of North Ulmsted shall be issu.ed
<br />in anticipation of the collection of assessments by installments and in an amount equal
<br />thereto.
<br />Section 7: That this resolution is hereby declared to be an emergency measure
<br />necessary for the i.mmediate pxeservation of the publzc peace, health, safety and general
<br />welfare of the City of North Olmsted, and such. emergency exists by virtue af the necess-
<br />ity of makirig immediately available additional parking facilities for the use of St.
<br />Richa,rd's Church and School, all for the benefit of the public peace, health, safety
<br />and welfare of the City of North Olmsted.
<br />Section 8: Wn erefore, this rzsalution sha11 take immediate ef.fect from an+3
<br />after its passage, otherwise, at the earliest period allowed by law,
