<br />AND DECLARING AN EMERGIIICY.
<br />NOW, THEREFOFiE, BE IT RESOLVED by the Council of the City of North Olmsted,
<br />State of Ohio, three-fourths of a,ll members elected thereto concurring:
<br />Section 1: Tha,t it is deemed necessary and conducive to the public health,
<br />convenience and welfaxe that Canterbury Road from Lorain Road northerly to the northerly
<br />city limi.ts be improved by constructing and installing a five foot concrete public
<br />sidewalk on both sides thereof, in accordance with the plans and specifications prepared
<br />by the City Engineer.
<br />Section 2: That the grade of the street shall be the grade shown on the
<br />plans and specificatians for said improvement, which said grade and elevations are
<br />hereby confirmed and established as the grade of said street.
<br />Section 3: That the plans, specifications, estima,tes and profiles of the
<br />proposed improvementt heretofore prepared by the City Engineer and now filed in the
<br />office of the Director of Public Service, be and the same are hereby approved.
<br />Section 4: That the cost of said improvement shall be assessed by the foo-t
<br />front upon the following described lots and lands, to wit: a,ll lots and lands bound:ing
<br />and abutting upon the proposed improvement, which sa,id lots and lands are hereby deter-
<br />mined to be specially benefited by said improvement; and the cost of sai.d improvemen-t
<br />shall inelude the expense of preliminary and other surveys, of printing and publishing
<br />the notices, resolutions and ordinances required, the serving of saici notices, the
<br />cost of construetion, together with interest on notes or bonds issued in anticipatio2i
<br />of collection of deferred assessments and all other necessary expenditures.
<br />Section 5: Tha,t the assessments to be so levied shall be paid in ten annutLi
<br />insicallments, with interest not to exceed six percent per annum on deferred paymentsr
<br />provided tha,t the owner of any property assessed may, at his option, pay such assess-
<br />ment i.n cash within thirty clays from and after the passa,ge of the assessing ordinance,
<br />in which case said assessment shall not include any item of interest upon notes or
<br />bonds to be issued in anticipation of the collection of deferred instal].ments of
<br />assessments.
<br />Section 6: That notea or bonds of the City of North Olmsted shall be issued
<br />in anticipation of the collection of assessments by installments and in an amount equal
<br />thereto.
<br />Section 7: Tha,t this resolution is hereby declaxed to be an emergency rneasure
<br />necessary for the imnnediate preservation of the public peace, health, safety and general
<br />welfa.re of the City of North Olmsted, and such emergency exists by virtue of the necessity
<br />of immediately providing to proceed with the installation of said public sidewa,l.k so that
<br />it may be installed prior to the comencement of the school term.
<br />Section 8: Wherefore, this resolution shall take immediate effect from and,
<br />after its passage, otherwise, a.t the earliest period allowed by law.
