<br />of Taxatioa, State of Ohio, ma,de an entry in the appeal perfected by the City of
<br />Rocky River et a1 in Case Nos. 41659 thraugh 41665, inclusive, 41668, 41669, 41683,
<br />41684, 416a9 and 41691, being appeala broRa.ght by appellanta agaiset the G'uyahoga Caunty
<br />Budget Commission and the City of North Olmsted relating to the allocatiari of loeal
<br />government funds by the &idget Commissicra of Guyahoga Ccyunty to the City of AJOrth
<br />Olmsted for the year 1960, which entry the Council, of the City of.North Olmsted does
<br />not at thie time believe advisable to appea3., and
<br />WRLTEAS, it is reported by the Solicitox- and special cwunsel assisting the
<br />Solicitor and represarrting the City in ths above captioned aetions, tha,t it appears
<br />an error is conta,ined in the entry made by the Board of Tax lppesls in the matters
<br />hereinbefore referred to and which error has been braught to the Board's attention, and
<br />WHE'RN;BS, at the preseut time t;wncil does not deem it advisable to appeal the
<br />deaision of the Board of Tax Appeals in this matter, but to make provision for defendirg
<br />the entry in the event appellants in the ma,tters before the Board of Tax Appeals relati.ng
<br />to this matter may appeal,
<br />NOW9 THERMRE, BE IT ORDAIlM by the Council of the City of North Olmsted,
<br />State of Ohioa
<br />Section ls That the firm of Baker, Hostetler & Patterson is hereby retained
<br />as special counael to assist the Solicitor of the City of North 0lmsted in defending
<br />the position of the Gity in the ma,tters now pending before the Board of Tax Appeals
<br />of the State of Ohio by perfecti.ng an appeal in the event that the entry of April 18,
<br />1960, ma.de by said Board, or ar?y corrected entry hereafter made involving said matter
<br />before the Board, is appealed by the appellants.
<br />Sectian 21 That this ordinance is hereby declared to be an emergency measuxe
<br />necessary for the immediate preservation of the pu.blic peace, health, sa.fety and general
<br />welfare, atld sueh emnergency exists ny virtue of the neceeeity of retaining special
<br />counsel to aesist thg Svlicitor in defending the positian of the City as a result of
<br />the aritry made by the Board of Tax Appea].s in the matter i.nvolvirig the city's allocati.on
<br />of local government funds for the calendar yeax of' 1960, which appeal date will be on
<br />or before May 18p 1960, there being no prior Cauncil meeting before said date to so
<br />employ such sgecial counsel.
<br />Section 3t Wherefore, thi.s ordinance sha11 take immediate effect from and
<br />after its passage, othenrise, at the earliest peri.od allowed by law.
