V <br />CI'1'Y UF NORTH OLMSTED <br />URllINANCE N0. <br />BY <br />.A1V URUINANCL RF;QUESTING APOINT OF ACC h-SS TO BROOKPARK xUA:D <br />(SR 17) BETWEEN FI,EiARTX' RUAD AND COLUMBIA ROAD, F'OR `L'HE <br />PUE3PUSES OF AMRDING P1URE ADEQ,UA`l'E USE OF PRI,fi:tlSES ABUTTING <br />Slt 17 BETWEEN FLEHA:RTY RUAD AATD COLIJP'IBIA ROAD, AND D-OCLAHING <br />AN .NZlh.RGENCY. <br />WHEREAS, the Council of the City of No:rth Ulmeted has heretofore, by <br />Ordinance 1979, enacted May 5, 19549 consented to the improvement of Brookpark <br />Road (SR 17) according to the plans filed with the City by the State Directnr of <br />Highways reflecting Brookpark Road within the corporate limits of the City as a <br />limited access highway and inaicating those points of access to said highway within <br />the corporate limits of said City, and <br />WFiEREAS, since 1954 and the improvement of Brookpark Road as a limited <br />access highway within the corporate limits of the City, accepting those designated <br />access points appearing in the original plans fil.ed by tne State Dixector ot' Highways <br />w:ith the City and as amended by vrdinance 2504, (anacted July 15, 1957, and Ordinance <br />2744, enacted September 16, 1958, and <br />WHIIAV?, Council and owners of premises abuttzng Brookpark Road have endeava.r- <br />ed to derive a plan for the development of lands abutting SR 17 in a manner most <br />advantageous to the owners thereof and to the City, and <br />WHEREAS, the premises abutting SR 17 on the south from Fleharty Road to <br />Columbia Road, excepting the corner properties on the southiaest corner of Columbia <br />Road and Brookpark Roadt are presently in a zone for light industrial use and on the <br />north of SR 17 for multiple housing and single fFUnily residences, and <br />WHEREAS, since the construction of SR 7.7 sa,id lands have rema.ined vacant <br />and uni.mproved and i.n all likelihood, in the opiriion of Council, will so remain <br />unless suitable planning of said area and an aceE:ss point to Brookpark Road between <br />the points heretofore mentioned is afforded, and <br />WHEREAS, Counci.l determines it necessary that the State Director of Highways <br />grant such access point for the more complete deirelopment of said area, a.dvantageous <br />to the property owners and to the City, <br />NOW9 THµ ' RE, BE IT URDAINED by the (;ouncil of the City of North Olmsted, <br />State of Ohio: <br />Section lt That Counci.l dee.ms it abso7.utely necessary, for the more eff'-cient <br />development of vacant lands abutting Brookpark Road (SR 17)s thwt an access point <br />be obtained from the State Direcf,or of Highways i;o said land abutting said improvement <br />between the present access point at Fleharty Roae1 and Columbia Road, and that the <br />Clerk of Council be directed to forward an attesi,ed copy of this ordinance to the <br />State Director of Highwa,ys and the Division Engirieers Office in Cuyahoga County, Ghio. <br />Section 2: That this ordinance is hereby declared to be an emergency measure <br />necessary for the preservation of the public peace, he,&h, safety and welfare of the <br />City of North Qlmsted, and such emergency exists by virtue of the necessity of ascertain- <br />ing the position of the State Department of Highrrays to a proposed access to Brookparl; <br />Road at a point to be located between Fleharty Rc>ad and Columbia Road and upon receipt <br />of said advice from the State Department of Highways on the q_uestian to proceed, to <br />more adequately provide for the development of tYiis area i.n the City of North Ulmstede
