<br />LIN ES SERYE THE SL'WERAGE ITYATMaT PLANT tTNDER CONSTKUCTIaN,
<br />AND DECLARING AN 'iiEMGr'MCY.
<br />WHERZEAS, i.n connection vrith the constxuction and operation of the sewerage
<br />treatment pZant for the City of North Olmsted, it ha.s become necessary to obtain a
<br />pexmit from the Metropolitan Park Board for the irastallation of said service liraes
<br />over and across lands of said paxk district, and
<br />WfiL"? ?tI;AS, said Nletropolitan Park Board, by Resolution 33319 has authorized
<br />the issuance of a permit to the City for the in.sta.llation of said service li.nes
<br />setting forth conditions re2ative to the installation and maintenance of said lines,
<br />which conditions the City has found acceptable and agrees to comply with,
<br />NpW, THERE14'C}RE, BE ZT JLd:rULVE*D by the Council of the City of North Gluisted,
<br />State of Qhio:
<br />Section 1: That the Service Director be and is hereby authorized to file
<br />an attested copy of this resolution with the C3eveland Metropolitan Park Board
<br />accepting the permit issued by sa.id Board for the installation acrass lands of said
<br />Boa,rd of water lines, gas 2ines, s-torm sewer line and an out fa11 sewer line and the
<br />conditions for the installation and maintenance of the same, as set forth in Resolution
<br />3331 of the Metropolitan Park Board. Said Service Director is further authorized ana
<br />instructed, in compliance with the terms and conditions fixed by said Boaxd for the
<br />maintenance and installation of said utility lines, to furnish said Boasd sufficierz.t
<br />surety bond in the siun of Ten `lhousand Dollaxs ($10,000.00) guaranteeing the perfox•mance
<br />of the conditions fixed an said resolution of the Park Boaxd, heretafore referred to,
<br />and the restoration of said lands to the present conriition upon completion of the
<br />installation of said utility lines. Said 5ervice Director, in the event present
<br />surety bonds of the City fxom the contractor guar.anteeing the performance of the work,
<br />axe not sufficient, is authorized and directed to secuxe said surety bond to meet the
<br />requirements of Cleveland Metropolitan Park Board.
<br />Section 21 That this resolution is he:reby declared to be an emergency measure
<br />necessary for the immediate preservation of the :public peace, hea].th, safety and welfaze
<br />of the City of Noxth Olmsted, and such emergency exists by virtue of the necessity af
<br />making immecliate arxangements for the installation of utility lines, heretofore
<br />referred to in Section 1 of this resolution, necessary in the construction of the
<br />sewerage treatment plant now under construction on the site of said city's sewera,ge
<br />treatment plant contiguous to the abutti.xg line of the Metropolitan Park Board through
<br />which utiiity lines of necessity niust run, al.l for the immetliate preservation of the
<br />publie peacep healtn, safety and general welfare.
<br />Section 3s WliereFore, this resolutiorA shall taice immediate eff'ect irom and
<br />after its passage, otherwise, at the earliest period allowed by law.
