CITY QF PTORTH OIMSTLM <br />RESOLUTION N0. <br />, . <br />By <br />, <br />t <br />RESOLUTION AUTHQRIZING THE SEFiVICE DIRECTOR TO ADVERTISE Ft?R <br />BIDS F(?R 450 FEW QF C75 REINFORCED CONCRETE PIPE, AND DECLARING <br />AN °iZIERGENCY. <br />WHIM1i:A5, it has been directed to the attention of Council, by residents <br />of Lansing Drive, that efforts to clean and widen a drainage ditch passing through <br />the property of residents of Lansi.ng Drive have been made, and <br />WHEREAS, the work required to deepen and clean sai.d ditch has resulted <br />and if continued will result in damage to the property of said residents, i;he Council <br />has determined it feasible to relocate a portion of said diteh withan the right of <br />way of Lansing Drive, necessitating, when so relocated, the reta.ling thereof, <br />NaWt THEREFONE, BE IT RESOLVED by the Cauncil of the City of PIorth (3lmsted, <br />State of Ohios <br />Section ls That the Service Director is hereby authorized and directed to <br />advertise for bids for 450 feet of C75 reinforced concrete pipe 3 feet in diameter, <br />or in the alternative 42 inches in diameter, to be used as necessary in the relocation <br />af a dxainage ditch in Lansing Drive. <br />Section 2: That this resolution is hereby declaxed to be an emergency <br />measure, necessary for the immediate preservation of the public peace, health, safety <br />and general welfare of the City of North Qlmsted, and such emergency exists by virtue <br />of the immediate necessity of preparing to relocate the ditch where work has been <br />stopped, pa.ssing through properties of residents o:f Lansing Drive, to a position within <br />the right of way of Lansing Drive, thereby preventi.ng further damage to property of <br />said residents, and making prompt provision for drainizg water from the area served <br />by said diteh, which deepening to date to the point where work has stopped has <br />i.mposed a serious hazard to the health, safety and property of the residents abutting <br />thereon and to the community generalfy. <br />Section 3: Wherefore, this resolution sizall take immediate effect from <br />and after its passage, othervrise, ;:,t the eaxliest :period allowed by lawo <br />Passed: 2 ° i?'
