<br />water and stavi.ng off of sedi.mentation by virtue of erosion into the lakes on abutting
<br />property to the north and in the course of said work i.n the removal os the putrid conditian
<br />ca,used by the construction of said dams, prejudicial to the health, comfort and convenience
<br />of the citizens of the wrea, if necessary, enla.rge such cu.lverts and covEred drains to
<br />meet the requirements as deternza.ned by the City lingineer, all within thirty days after
<br />the expiration of -the publication of this resolution, the last oF said publication to be
<br />Au?ust 17, 1959•
<br />Section 2: That the Service Director be and is hereby directed to forward a
<br />copy of tYii,s resolution to the record o;=mer of said preznises herein involved and to al.3
<br />persons having an interest therein, now determined to be Mr. & Tfirs. Erncst Walters resid.in.g
<br />at 8197 State Road, North Royalton, f3hio, and Blaine and Joyce Whitaker, as tenants of
<br />Exnest Tgalters, occupying premises at 6196 Columba.a Road, North Olmsted, Ohio.
<br />Section 3: :in the event the oVmer of said premises herein described in Section 1
<br />of th.is xesolution or other persons interested therein r efuse or fail to perform the
<br />necessary work hereby required, the Service Director is hereby authori<;ed and directed
<br />to perform said work at the expense of the city and to process the colleetion of the
<br />anount expended by said city in the pex£ormance of said work as authorized by 7.aw.
<br />Section 4: Th.at this resolution is hereby detezxn?ned to be an emergency mea.sure
<br />necessary for the immediate preservation of the public health, safety and welfare of the
<br />City of Tdorth Qlmsted, and such emergency e.;ists by virtue of the serious impairment of
<br />the health, comfort and convenience of the citizens oi' the neighUoxhood, impaired by the
<br />blocking of natural water courses and re-routing of na?ural water coursesg which condition
<br />has been called to the attention of the owners to abate and co=rect i,n P•Zarch of this year
<br />and which to this date has not yet been cor:eected or abated, and due to the season of
<br />the year and the a,pproaching wet Yi:eather tiJill cause iurth.er inconvenzence to the hea.lth
<br />and com:Port of the citizens of the neighborhood if not corrected immedia.tely.
