UPP FR4NTING ON NCRTH <br />PCETEt R(kA,D AND EXTENDING 6dFSTEftLY., A DISTAIdCE QF 2$3.55 <br />FM WESTEELY FR(14 THE CEffM LINE QF EAST PARR DRIM <br />FOR THE SIIM QF $2000.00, AND DECLARING AN ENMGENCY. <br />WHU,EAS., the City has undertaksn to nsgotiate the acquisition of a <br />tract of land extending from ATorth Forter Ro$d to a point ;dests.rlg af Egst <br />Park I}rive, a distance of approaimately 283.55 feet from the center 7 i.ne <br />thereof# owned by Fannie H. Upp., being approafmately 50 feet in widtdl and <br />1286,10 feet in ].ength fo;r street purpasesp and <br />W!HEREAS, it has been reported to Covncil that said tract of land <br />for street purposes can be sequ.ired from Fannie H. Upp for the stm of $2000, <br />whieh sun is available for said ptxrposes from the Permanent Improvemertt Fund <br />and that Cowlcil has determ3ned that sai.d consideratioa for sai.d tract of <br />7.and to be fair and reasonable. <br />NOWs ?EREFCREs BE IT ?AINED by the Council of the City of Narth <br />Olmsted., County of Cuyahoga and Sta{,e of Chio: <br />Section ls That the Service Director be author3.zed to purchase i.n, <br />the name of the city of North Olmsteds the fee simp1e tit].e of a parcel of ].azid <br />from Fannie H. UpP for street purposes for the sun of $2E)00.00. Th?,t said . <br />tract oY land is the southerly 50 feet of the property of Fanni,e H. Upp fronting <br />on the westerly side of Nvrth Porter Road and eacctending westerly between approxi- <br />mate]y parallel Iissess a distance of approx3lna,tely 1286.10 fest beirg to a point <br />approximate]y 283.55 feet westerly of the center line of East Park Drive. <br />Sectioa 2: That the Auditor be directed to draw the surt of $2000.00 <br />from the Permanent ?.mprovement Fund for such aequisition and to pay said snm to <br />Fannie H. tFpp when aWarranty Deed is delivared to the Citg together with a Tit1.e <br />GuaY'antpa guarantesing title in the amount of $2000.00 in the naade of the City of <br />North O7Ynsted showirag certain premises to be free and clear of a11 encumbrances <br />whatsoever excepting taxxes for the Last Half of 1958 and thereafter. <br />Section 3= That the City gngineer is d9sected to prepare a 1ega1 <br />description for said parcel of land and that the Director of Eawj, thereafter., <br />to order the Title Guaranty for said acquisition from The yand Title Gu.arantee <br />& Trust Co., with apprapriate instructiorjs and as a f'urther consideration for <br />said acquisitions the City of North Qlmsted is obligated to pay the cost of <br />said Title Guaranty.. <br />Section 4: T?ereforej, this Ordinance is hereby daclared to be an <br />emergency measure necessary for the imnediate preservation of the publ3c pewes <br />healtri' aafety and general welfare of the City of North 07insteds and suah <br />emex'genQy exiats bp virtue of the neeessity of abtai ning title to a traet of <br />laad for strest pzn poses wh3.ch tract is presently used as street pvrposea thereby <br />permittirig the proper installaticn of ntil3.tiea therein and the ?ainte?ance of <br />the roadway thereby eliainati.ng the present hazardous eanditions there3.n existing. <br />Seetion 5: Wherefore$ this Ordinance shall take imened3.ate effect t`rom <br />and after its passages otherwisej, at the earliest period allowed by l.aw. <br />R A. aze ton., esident of onnc <br />?y <br />? <br /> <br />PA.qfiTaT1• APRTT. 9R+1, _ l Qr?O
