. <br />Upon the filing of an application for a perm3.t and during <br />the 10-da3r waiting period herein abcve referred to, the Building <br />Official or his anthori.zed Irispeetor shall make an 3.ns,pevtion of <br />the property to be improved and determi.ne the elevaticn arid grada <br />reqnested to be estsblished on the prainises involved not to be <br />injurious to ad3o3ning property. <br />Ax?y- property ouner or person who has reason to bel3sve that <br />the proposed elevation and grade may be hazardous or iajtir3.ous <br />by v3rtue of a prcrposed change in elsvation or grade., cr in the <br />construction contemplated by the application for a bnilding perm3.t, <br />may fils its' his or her Qbjections with the Board oF Building Code of <br />Appeals. The Board of Building Cods of Appeals shall upon recsipt of <br />such protest: notify the applicant and t,he objec-tor , of t ?t???? <br />a hearing before the Bc?ard on said ob3eationa which shall n? ?a) <br />weeks after the fi7.3.ng of such written protest. <br />?.,.,. <br />Section 2: seot3oA 1505.021 - In the event that the arppl.3.cation for a <br />building pezast required under the provisions of Chapter 5 of th'dinarice 2645 <br />involves the proposed construction of or alteration of arW dwe113.ng or appurtenant <br />structure on a lot having 50 feat or less frontage on an exitsting street., said <br />application shall., in additioa to the prov3sions of section 1505.02 of trdinanas 2645 <br />as amended by Section 1 of this crdinaaae,, be refarred to t,he Board of Huild3.ng Code <br />of Appea7.s whieh Board ahall in additian to rrxling on any protest that mW be filed <br />with it, first dstermine prior ta the approval af the appliaatian for a permit for <br />said premises determine that said propoaed construction or altsration doas not sffect <br />drainage of surface wster or waste unta or over adjo3.ning property or into anpr publ•ic <br />street as may be injurions to the pub7.ic safetys health or welfare. <br />Sectioa 3: Each section of this ordinance is hereby declared to be in- <br />dspendent sectlons and parts of gections., and it is herebg devlared to be the intent <br />of the Gouncil of the City of North 03msted that if any provi.sion af sa:i.d ssctions <br />or the appl.3.cativn thereof to arpr person, firm or corporatioa ar circwmtances are <br />held to be invalid for arW reasonj the remaining sections or parts of sectiona and <br />the appl3.cation of suoh provisiona to any person or cireumstances other than those <br />as to which it is hsld irva13-d, shall not be effseted therebg and it is herebg <br />declared that this ordinab.ce wro'u7.d have been pas,sed independently of such seetion., <br />sections, or part of asection, so held to be imrala.d. <br />Seetion 4: Vaerefore., th3.s ordinance is hereby declared to be an aznergency <br />measure neceasary fcrr the i.mediate preservation of the publio peace., healt,hs aafety <br />and welfare of the City of North Ct].msted, md such emsrgeney exi.sts by virtue of the <br />necessity of more adequatel,y' presez'v'ing the hsalth of sai-d City bg public notif'ication <br />of ar{y proposed alteratian of elsvation and grade of property to be improved and <br />digposition praposed to be made of surface water and waste. <br />section 5: Wherefore,, this ordixiance shall take immedi.ate effecst f5rom <br />and after its passage., otherwise, at the earliest period allowed by law. <br />PASSFD: <br />AT'I'EST : -_-- ; , <br />-? <br />E.
