<br />WF.~'~EAS under date of January 9, 1957, the developer of Theresa Lane
<br />deposited by Pay Order No, 654 the sum of $118.7., in trust, to be paid
<br />the contractor Vii. J« Platten Son Construction, Inc., upon complotion of
<br />the installation of the road (Theresa Lane) tzr_der contract with the d®velo;~er,
<br />and
<br />WH.gREAS, on October g, 1957, the Nicholas Molnar Organization, the con-
<br />tractor, constructing a residence mown as 5152 Park I,2ne, deposited in trust
<br />by Pay Order No. X938, the sum of X128,00, for the construction of a sideT~ralk
<br />and
<br />wHE£'.E'AS, said funds are sti71 on deposit with the City of North Olmsted,
<br />and
<br />TrJI~ZE',AS, the Nicholas :Komar Organization, developer of Theresa Lane, has
<br />currently disposed of his construction business in this area and removed to
<br />Florida, and
<br />WfiEftEAS~ it has been determined that Theresa Lane was not improved in
<br />accordance with the Improvement Plan on file with the City of North f}lmsted
<br />and under the ordinances of said City and negotiations with the M. P. Platten
<br />Son Construction, Inc. and the City, resulted in a compromise of the various
<br />parties for the purposes of making said street accieptab].e for dedication and
<br />to the residents residing thereon. It was determined that M, P. Platten Son
<br />Construction, Inc. proceed to furnish the material and labor for said improve-
<br />ment to which he Mould contribute lOt?0 (estiriated to be one-half of the cost
<br />of said improvement) and the developer of said subdivision contribute `250.00
<br />plus. The aforementioned funds held by said City, in trust, and the balance
<br />of the cost of labor and material for the improvement of Theresa Lanes;. to be
<br />paid by the City.
<br />NOW, THEftEFOEtE, BE IT R.ESOLV'e.~..D by the Council of the City of North Olmsted,
<br />County of Cuyahoga anal State of Ohior
<br />Section 1: Tzat the Auditor be authorized and is hereby directed to
<br />transfer to the ts5txeet Maa.ntenance Fundtr monies paid into said City, in trust,
<br />by Pay Order No. 65J,sll. amounting to ~118.7ls, and by Pay Order No. 6938 in the
<br />amount of X12$.00, be transferred from said Trust Fund of said C~.ty..
<br />Section 2: That this Resolution is hereby declared to be an emergency
<br />measure r_ecessary for the preservation of the General public safety and welfare
<br />and such emergency exists by virtue of the necessity of paying the costs of the
<br />ir~rovement to Theresa Lane by ~?. P. Platten Son Construction, Inc, in order to
<br />effect the improvement of said street to make said street acceptable for dedica-
<br />tion and which work has been completed to the satisfaction of the City Engineer
<br />and the cost thereof submitted to said City for payment under the terms and
<br />conditions of the compromise heretofore referrBd to.
<br />Section 3: Wherefore, this Keso lotion shall take immediate effect from
<br />and after its passage, othertrise, at the earliest period allowed by law.
