<br />?odH~RLAS, it has been determined that damages ,~rere sustained by Brian F.
<br />Stock, a minor 16 years of age, by virtue of an accident occurring on Lorain Road in
<br />the City of North Olmsted on July 19, 1958, and
<br />i~JFTlrr"T:E:',~5, an investigation resulted in determining that there existed a
<br />hazardous condition in said road causing said accident, and
<br />WTTERE~sS, it is determined a justifiable and valid claim,

<br />State of Ohio:
<br />Section 1: That T~iarjorie H. Stock, mother of Brian P. Stock, and :Brian P.
<br />Stock be paid the sum of Two Hundred 'ithirty-Six and 67100 Dollars (~~236.57) as and ,~'or
<br />all damages sustained or arising from an accident occurring on Lorain Road on July l;',
<br />1958 near the intersection of Porter P~oad, wherein the motor scooter being operated by
<br />Brian P. Stock struck a hole in said thoroughfare throwing Brian F. Stock from his
<br />scooter onto the ~aavement and injuring said Brian P. Stock to the e.,tent that he required
<br />hospitalization, medical attention, including 1-rays, and dental care and said scooter
<br />was damaged as a result of said accident, and that the total out-of-pocket expenditures
<br />of said T~Zarjorie H. Stock, the mother of said minor, amounted to X236.67, the amount
<br />which said Trtarjorie H. Stock, individu~~„lly and on behalf of said minor, Brian I'. Stock,
<br />and Brian P. Stock agreed to accept in full settlement of sny and all claims for damages
<br />of whatsoever nature, kind or description arising from the accident and to give a re1e~:~se
<br />to said city releasing said city from any r_:nd all claims of whatsoever nature.
<br />Section 2: r.1'hat the Auditor tae directed to issue the city's draft pay^,ble
<br />to T-iarjorie H. Stock and Brian T'. :Mock in the sum of :2j6.~7.
<br />Section 3: +om.erefore, this ordinance is hereby declared to be an emergency
<br />measure necessary for the immedi~~te preservation of the pu'alic peace, safety and :-relfa-re
<br />of the City of North Olmsted, and such emergency exists by virtue of the nE:cessity of
<br />adjusting the said claim of T~Tarjorie TT. Stock and Brian P. Stock promptly, thereby
<br />avoiding possible litigation invdvin~ the City of North Olmsted by virtue of its ~.ia~Ji_i.-
<br />ity in connection with said accident occurring on Lorain Road on July 19, ~-95a•
<br />Section 4: 's~Therefore, tnis ordinance shall take irunediate effect from ;.nd
<br />after its passage, other~:rise, at the earliest period allowed by lati~r.
