ORDINANCE N0. _,~~7 S~~ Page 2. <br />'tSection 1: That the proposed location of a point of access, <br />identified as Point E, to Brookpark Boad (S8 17) at a pout 15ao t® 1545 feet <br />Bast of the istersectios of Breokpark Road (58 17) and Lorain Boad (SR 14), <br />be approved in accordance with the plan thereof as reflected on the attached <br />Schedule A which is made apart hereof, and if said point of access to SR 17 <br />is hereinafter approved by the State Director of Highways, then the eziating <br />points of access identified as A, B, ~, and D will be peraaneatly clewed and <br />will not thereafter be useable as points of ingress and agrees to SR 17." <br />Be amended to read as fallowa: <br />Section l: That a point of access from the shopping eenter located <br />Southerly of the intersection ®f Brookpark Boad (SR 17) and Lorain Head (SR 1D) <br />,., be at a pout approxiaately 1818 feet to 163 feet Easterly of the interaectioa <br />of aforesaid Highways, and in accordance with the plan thereof as reflected on <br />the att4ehed Schedule A which is made apart Ysreef, cad if said proposed re- <br />location of the access point Pros the shopping center to SR 17 is hereinafter <br />approved by the State Director of Highways, than the heretofore •atabliahe8 <br />proposed access point and all other aceesa points heretofore identified on the <br />ezhibits attached t® Ordinance loo. 2504, and the access point as therein located <br />by said Ordinance will be psrmanaatly closed and not thereafter useable as points <br />of ingress and egress to or Eros SR 17. <br />Section 2: That all other obligations of the City and the developer as <br />established by Ordinance No. 2504, are hereby reaffiraed as the obligation of the <br />respective parties. <br />Section 3: That if the proposed relocation of said access point from <br />SR 17 t® the shopping center is approved by the Director of Highways, the <br />Service Director of this City is hereby directed to forward a copy of this <br />Ordinance, properly attested by the Clerk of this City, to the Director of <br />Highways notifying the Birector of Highways of the action taken by this Cotlntil. <br />Section 4: The Service Director is hereby authorised to issue all <br />necessary permits is accordance with the proposed plena submitted for the <br />relocation cad modification of the proposed access to SR i7, upon the approval <br />of said relocation by the Director of Highways of the State of Ohio. <br />Section 5s This Ordinance is hereby declared to be as emergency <br />aeasure necessary for the immediate preservation of the public pease, health, <br />safety and welfare of the City of North p3.asted and such emergency exists by <br />Virtue of the ascesaity of relocating the pr0poaed access point Eros the <br />Shopping Center parking area to Brookpark Road (SR 17) at a peist 31$ feet <br />or thereabout from the present proposed access paint which sew location of <br />acid access paint will bs approximately 1818 feet to 1863 Pest Sasterly of <br />the intersection of Broo~apark R®ad (SB 17) and Leraia Road (S8 10), which <br />fact the developer of the shopping center cad the prospective tenants to <br />bs located therein, cad the Council of the City of North Olmsted, have determine <br />that said relocation of the aceesa point here cad above rsterred to will result <br />is a more effective control of traffic from Broekpark Road (SR 37) into cad <br />from the parking area servicing the shopping cantor, thereby mare effectively <br />preserving the public peace, health, safety cad welfare of the City of North <br />Olmsted. <br />Section 6: t~iEREFORE, this Ordinance shall take immediate effect <br />from and after its passage, otherwise, at the earliest period allowed by law. <br />PASSED: ~~.~ <br />ATTEST: <br />_ ..__. <br />. .., .N> <br />E.
