CITY OF NORTH OLMSTED <br />RESOLUTION NO. <br />By P'Ir . Hinkl e <br />RESOLUTION TRANSFERRING FUNDS FROM AATDREW J. MURANKO TRUST <br />FUND TO ANDREW J. MURANKO IMPROVEML~+TT FEJND, AND DECLARING <br />AN E[~RGENCY . <br />WHF~I,AS, it has been reported to Council that Andrew J. Muranko made a <br />deposit with the city under permit issued to Andrew J. Muranko No. 58 and 65, of the <br />sum of $480.00, which sum was placed in the Andrew J. Muranko Trust Fund for the <br />purpose of securing a performance of said. Andrew J. Muranko, a builder, in the <br />construction of homes in the City of North Olmsted of sufficient funds to insure the <br />cost of the installation of sidewalks and other necessary improvements in accord2.nce <br />with the ordinances of the city, and <br />tiJHEREAS, it has been determined and reported to Council that Andrew J. <br />Muranko has failed to install said sidewalks and make other necessary improvements <br />under and by virtue of permits issued to said Muranko or to act upon notification <br />given him by the Service Director of the city to make said improvements, and which <br />failure to act the Council hereby determines to declare said fund forfeited and <br />direct the transfer of the fund to the Andrew J. Muranko Improvement Fund to permit <br />the city to proceed to make the necessary sidewalk installation and improvements to <br />the property of Andrew J. rTuranko as directed by the Service Director, <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted, <br />State of Ohio: <br />Section 1: That the Auditor is hereby directed and authorized to transfer <br />$480.00 from the Andrew J. Muranko Trust Fund to the Andrew J. Muranko Improvement Fund <br />for the purposes of providing Binds to reimburse the city for making the necessary <br />sidewalk installations and repairs to the property of Andrew 3. Muranko as directed. <br />by the Service Director of this city. <br />Section 2: That the Service Director, having notified Andrew J. Muranko <br />to comply with the ordinances of the city in the matter of installing sidewalks and <br />making necessary improvements in the city and which notices have been disregarded by <br />Andrew J. Muranko, is authorized to proceed with making the necessary installation of <br />sidewalks and repairs and improvements to the property of said Andrew J. Muranko in <br />conformity with the ordinances of this city, charging to the said Andrew J. Muranko <br />Improvement Fta.n.d the cost of making said installations and improvements and to refund <br />to Andrew J. Nfu.ranko any excess remaining of the Andrew J. Muranko Improvement Fund <br />over and above the cost of said installations and improvements. <br />Section 3: This resolution is hereby declared to be an emergency measure <br />necessary for the preservation of the public health, safety and welfare of the City of <br />North Olmsted and such emergency e,tists by virtue of the immediate necessity of making <br />certain installations of sidewalks and improvements on the property of Andrew J. Mur:~nka, <br />the condition of which property results in a public nuisance and. impairment to the nutslic <br />safety, all for the preservation of the public health, safety and welfare of the City <br />of North Olmsted. <br />Section 4: Wherefore, this resolution shall take immediate effect from and <br />after its passage, otherwise at the earliest period allowed by law. <br />Passed: _ Jul.~r 31, 1958 <br />E.
