R._______________________ <br />/'f,~ /, , <br />OI3.DINA.NCE NO._______~~_°_ _~_~____ <br />~~ <br />DATE OF ENACTMENT-- -__-_-- _-~~ 0». <br />City <br />An emergency ordinance enacted by the die of__No___i~_J1r_=t= c___ <br />____________ Cuyahoga _____________County, Ohio, in the matter of the hereinafter described <br />improvement, under the supervision of the Director of Highways. <br />WHEREAS, the Director of Highways is considering improving a portion of the public high- <br />way which is described as #ollows: <br />(Location and general nature of work) <br />~~: <br />'~~"~ The improvement of S. CtJY.10=(fl.+)(~-x.95), the Cleveland-Oberlin Load, i.notm <br />locally as Lorain F~oad, by removing the existing asphaltic concrete where necessary, <br />removing existing brick on the approach to traffic lights, and replace with asphaltic <br />concrete. Resurface from curb to curb t>>iti~ asphaltic concrete on that part of the <br />designated route which lies within tl-ie corporate 1i:~lits of the City of North Olrnste-r'.. <br />Being in all, a distance of about ~.9b rai"s.es. <br />No Right of IJay required. <br />City North Olmsted <br />NOW THEREFORE, Be it ordained by the Council of the of____.________________, Ohio: <br />SECTION I (Consent) <br />City <br />That it is declared to be in the public interest that the consent of said a be and such con- <br />sent is hereby given to the Director of Highways to construct the above described improvement, <br />in accordance with plans, specifications and estimates as prepared by said Director. <br />SECTION II (Cooperation) <br />City <br />That said , hereby proposes to cooperate with the State of Ohio, in the cost of the above <br />described improvement, by assuming and contributing 'twelve and eight-tenths (i2.€;°!o) percent <br />of the cost of construction, plus one hundred percent (lOQ%) of the cost of all. <br />x~aterial and labor necessary to re-arrange and adjust to the new grate, al.l water <br />mains, service lines, fire hydrants, valbe boxes, sanitary sewers or other municipally- <br />ocaned utilities and/or appurtenances thereto necessary to conform to said improvement. <br />inclusive of the cost of engineering, contingencies and other incidental expenses. <br />SECTION III (Authority to Sign) <br />City <br />That the_____ Mayor _ _______________of said 3~i is hereby authorized to enter into main- <br />tenance and parking agreements and special contractual obligations. <br />SECTION IV (Maintenance) <br />City <br />That it is hereby agreed that said ~~€ will, after completion of the aforementioned <br />project, maintain the improvement herein contemplated in accordance with the provisions of the <br />statutes relating thereto and will make ample financial and other provisions for such maintenance, <br />and maintain the right of way and keep it free of obstructions in a manner satisfactory to the State of <br />Ohio. <br />PAGE 1 OF 8 PAGES <br />
