ENACTED <br />AUGUST 1, 1950, BEING AN C~DINANCE RESTRICTING THROUGH <br />TRUCKS FROM t~ERATING ON ROUTE 17 IN THE CITY C1F' NTH <br />C1L~TSTED, ~ D DECLARING AN EMF.~tGENCY. <br />TaHEREA5, it has been determined by Council to be advisable to restrict <br />through trucks from operating on Mastick Road from. the Easterly City Limits <br />of North Olmsted Westerly to Columbia Road for the purposes of preserving <br />said roadway and to cooperate with the Village of Parkview in its efforts <br />to restrict through trucks from operating on Mastick Road within its Village <br />limits. <br />NC?h', THEREFORE, BE IT OP,DAINED 'BY ~~ COUNCIL of the City of North 07.rmsted, <br />State of Ohio: <br />Section 1. That Ordinance No. 83~ enacted August 1, 1950, being an <br />Ordinance prohibiting the operation of through trucks on Route 17 within <br />the corporate limits of the City of North Olmsted, is hereby repealed. <br />Section 2. It shall be unlawful for through trucks to operate on <br />Mastick Road i.n the City of North O]snsted from the Easterly limits of this <br />City 'masterly to Columbia Road. A through truck is defined as any truck <br />not making a delivery to a point within the City of North Olmsted or which <br />is not making a delivery or pick-up from a point originating in the City of <br />North Olmsted. <br />Section 3. A vehicle which is propelled or drawn by power other than <br />by muscular power and designed for general highway transportation and used. for <br />drawing other motor vehicles or designed for use of drawing other motor vehicles <br />while carrying a portion of such other motor vehicles or its lord or both, and <br />further designed and used for carrying merchandise and freight or as a commercial <br />tractor, shall be considered a truck, particularly when there has been placed <br />thereon a license iasued by the Division of Motor Vehicles designating such <br />vehicle as a truck, <br />Section !~. Any person, firm or corporation operating or causing to be <br />operated a truck in violation of Section 2 of this ord:.nance, shall be charged <br />with the commission of a misdemeanor and upon conviction thereof, fined a <br />penalty not to exceed ~t9.~ and costs. <br />Section 5. Wherefore, this Ordinance is hereby declared to be an emergency <br />~~ measure necessary for the immediate preservation of the public safety and welfare <br />,~, ar_d such. emergency exists by virtue of the necessity of restricting through travel <br />on Mastick Road for the preservation of the road and the safety of users of said <br />highway. <br />Section 6. Wherefore, this Ordinance shall take immediate effect from <br />and after its passage, otherwise, at the earliost period allowed by law. <br />Passed: a .~ <br />ATTEST : <br />E. M.
