DRIVE FROM GRAGE ROAD 1T THE EASTERZY bINE OF METHt~'t~ITAN PARK AT~.l7fMBNT BY CONSTRUCTING TH~$E- IN A FT~'E Ft)OT CONCRETE PUBS~IC SSDEGiTAT~K OAT BO'T'H SIDES THEREOF, BE IT ORDAINID BY THE COUNCIL of the City of North Olmsted, State Ohio, three-fourths of all members elected thereto aonaurriag: Section l: That it is hereby determined to proceed with the improve- ment of Lucille Drive from Grace Road to the Easterly line of the Metropolitan Park Rl.lmtment by constructing and 3nstal].ing a five foot concrete public side- walk on both sides thereof in accordance with Resolution No. 261}!}, passed on the 4th day of Larch 195, and 3n accordance with the plans, specifications, estimates and profiles heretofore approved and now an file in the office of the Director of Public Service, Section 2: That all claims for damages resulting therefrom sha11 b® judiciously inquired into after the completion of the proposed imprt~vement and the Solicitor be and he is hereby authori$ed and directed to institute proceed- ings in a court of competent jurisdiction to inquire into such claims, section 3: That the entire cost of said improvement shall be assessed by the foot front upon the following described lots and ].ands towitr All lots and lands abounding and abutting upon the proposed improve- ment from Grace Road to the Easterly lime of the Metropolitan Park Allotment in the City of North Olmsted, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the expense of the prelimi.riaxy report and other surveys and of printing and of publishing notices, resolutions and ordinances as required, and the serving of said notices, the cost of con- struction, together with interest on notes and bonds issued in anticipation of the collection of d®ferred assessments and alI other necessary expenditur®s. Section l~.s That the assessments so to be levied shall be paid i.n ten annual installments with interest on deferred paysae+nts at the same rate as shall be borne by the bond to be anticipated in the collection thereof, provided that the owner of asay property assessed may at his option, pay such assessments in cash within thirty days after the preparation of the assessing ordinance, in which case said assessment shall not include arty item of interest upon notes and bonds to be issued in anticipation of the collection of the deferred installments of assessments, Section S: That the bonds of the City of North 0]msted shall be iss+.zed .. in the anticipation of the collection of assessments by installments and in an amount equal thereto and notes of said City shall be issued in anticipation of the levying of such assessments and the issuance of such bonds. Section 6: That the City Engineer be and ha is hereby directed to prepare and file with his council, a tentative assessment showing the amount to be assessed on each lot or parcel to be assessed, Section 7: That the Director of Public Service be and he is hereby directed and authorized, as soon as funds therefor are available, to make and execute a con- trast for said improvement with the lowest and best bidder after advertisement accord- ing to law,
