JURISDICTION OVF,R PRE~UCFR CO~JTR,ACTS Ft~t <br />THE SALE OF NATURAL GAS, AND BY INCORPORATING INTO LAW TAE <br />'~ FAIR-FIELD PRICE C(I~TCEPT IN ADMtNISTRATItA+T OF THL NATURAL GAS <br />ACTS AND DECLARING AN F~lERGENCY~ <br />WHERICAS, the Natural Gas Act of 1938 was passed by the Congress for the <br />primary purpose of protecting the consumers of natural gas against exploitation <br />at the hands of natural gas suppliers; and <br />4~III~tEAS, the Supreme Court of the United States in the case of Phillips <br />Petroleum Co. v. State of Wisconsin, et al., 3l~7 U. S. 672 (1950, declared <br />that the Natural Gas Act of 1938 encompasses the regulation of independent <br />producers of natural gas; and <br />6diEkF~AS, since the passage of the Natural Gas Act of 1938, the independent <br />producers of natural gas have obtained the introduction of at least sin mayor <br />legislative proposals in the various Congresses for exemption frog the provisions <br />of said A~et; and <br />T~IEREAS, the last of these legislative proposals was the Harris-Ftilbright B311 <br />which was passed by the 8l~th Congress but vetoed by the President of the United <br />States; and <br />W~iERT,AS, proposed legislation has been introduced again i.n the present session <br />of the 85th Congress of the United States, H. B. 6790 by Mr. Oren H~ris and H. B. <br />6791 by Mr, Joseph P. O~Hara; and <br />WI~1S, these legislative proposals have as their purpose the exemption of <br />independent producers from the jurisdiction of the Federal Power Commission save <br />a limited 3uriadiction over producer contracts for the sale of natural gas, and <br />would establish the fair-field price concept in the administration of the Natural <br />Gas Act; and <br />WHERE'~AS, such legislation would not be i.n the publ3.c interest because it would <br />violate the basic iirtandment of the Natural Gan ,Act of 1938 by abolishing the effec- <br />tive regulation of the cost of gas sold by producers, thus placing reliance on the <br />operation of the law of supply and demand in the ~'keting of this essential noa- <br />eompetitive fuel in an economic atmosphere of captive consumers and increasing and <br />unprecedented des+and; and <br />T~kgREaS, representatives of the public have conacient~usly opposed similar <br />legislation on behalf of the consumers of natural gas whose interests require <br />`"""' effective regulation of the natural gas industry; and <br />SEAS, this resolution constitutes an emergency measure providing for the <br />usual daily operation of a municipal department; <br />NOW, THEREFC~1?E, BE TT RESOLVED BY THE COUNCII, of the City of North Olmsted, <br />State of Rio: <br />Section 1.
