F= <br />CITY OF NORTH OLTZ51'ED <br />ORDIIVTANCE NO . rZ (~ ~ ,~ <br />By I~Tr . <br />AN ORDINANCE DETF:RIdZNING TO PROCEED WITH IMPROYET OF GESSN~i ROAD <br />FROM WALTZ ROAD Wr~STE:~t.LY TO COLUMBIA ROAD BY CONSTRUCTING THEREIN A <br />FIVE FOOT CONCRETE PUBLIC SIDEWALK,~ON BOTH SIDES THr:11E01', AND DECLtiRING <br />AN ~9ERGENCY . <br />BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio, <br />three-fourths of all members elected thereto concurring: <br />Section 1: That it is hereby determined to proceed with the improvement of <br />Gessner Road from Walter Road westerly to Columbia Road by constructing therein a five <br />foot concrete public sidewalk on both sides thereof in accordance with Resolution No. <br />259, passed November ly, 1957, in accordance with plans, specifications, estimates and <br />profiles heretofore approved and now on file in the office of the Director of Public <br />Service. <br />Section 2: `t'hat all claims for damages resulting therefrom shall be judicially <br />inquired into before commencing of the proposed improvement, and the Solicitor be and he <br />is hereby authorized and directed to institute proceedings in a Court of competent juris- <br />diction to inquire into such claims. <br />Section 3: `jhat the whole cost of said improvement thereof shall be assessed <br />by the front foot upon the following described lots and lands, to wit: all lots and lands <br />bounding and abutting upon the proposed improvement, which said lots and lands are hereby <br />determined to be specially benefited by said improvement, and the cost of said improvement <br />shall include the expense of the preliminary and other surveys, and of printing and pub- <br />lishing notices, resolutions and ordinances as required, and the serving of said notices, <br />and the cost of construction, together with interest on notes and bonds issued in antici- <br />pation of the collection of deferred assessments, and all other necessary expenditures. <br />Section 4: That the assessments so to be levied shall be paid in ten ann~:zal <br />installments, with interest on deferred payments, at the same rate as shall be borne <br />by the bonds to be issued in anticipation of lie collection thereof; provided that the <br />oVmer of any property assessed may, at his option, pay such assessment in cash within <br />thirty days after the passage of the assessing ordinance. <br />Section 5: That the bonds of the City of North Olmsted shall be issued i:n <br />anticipation of the collection of assesments by installments and in an amount equal <br />thereto, and notes of said City may be issued in anticipation of the levying of such <br />assessment and the issue of such bonds. <br />Section 6: That the City T~ineer be and is hereby directed to prepare and <br />file with the Council a tentative assessment showing the amount to be assessed on each <br />lot or p~~rcel of land to be assessed. <br />Section 7: That the Director of Public Service be and he is hereby authorized <br />and directed., as soon as the funds therefor are available, to make and execute a contract <br />for said improvement with the lowest and best bidder after advertisement, accordin.~; to law. <br />Section 8: That this Ordinance is hereby determined to be an emergency measure <br />necessary for the immediate preservation of the public peace, safety and welfare of the <br />City of North Olmsted. <br />Section 9: 1~Jherefore, this Ordinance shall take immediate effect from and aster <br />its passage, otherwise, at the earliest -period allowed by law. <br />Passeds ~Z~ /- ~9y <br />ATTESTS <br />CLERK OF COUNCIL <br />APPRO E~ <br />YOR <br />~rt ~ - <br />SIDENT OF C C L <br />~ nAh <br />~' vYY <br />~, <br />.i.. <br />
