CITY OF NORT~T OLI~S.STED <br />RESOLUTION N0. ~~~ <br />By Mr . <br />°" RESOLUTION AUTHORIZING SOLICITOR TO APPROVE JOURNAL ENTRY IN THE <br />°'"'~' INJUNCTION ACTION BROUGHT BY NIILDRED KNAPIK, Ems' AL, vs. CITY OF <br />NORTH OLMSTED, ET AL, AND DECLARING AN EMERGENCY. <br />WLiEREAS, Mildred Knapik, et al, brought an action against the City of North <br />Olmsted, et al, seeking injunctive relief against the city's operation of sanitary <br />land fill, and. <br />WHEREAS, heretofore a temporary restraining order was granted by the Court <br />of Common Pleas on the motion for a temporary restraining order brought by complainant, <br />which restraining order made it the obligation of the City of North Olmsted to perform <br />certain things in the use of the sanitary land fill, and which action subsequently was <br />pre-tried before Judge William Thomas on February 26, 1958. Plaintiffs' counsel anal <br />the City Solicitor representing the parties agreed that all of the provisions to be <br />performed under the temporary restraining order have been performed or the performance <br />assured, and that the provisions of the temporary restraining order to be made a per- <br />manent order related only to the requirement that the city bury and cover all rubbish, <br />waste and refuse daily with at least two feet of earth, and said temporary order <br />amended as above stipulated should become the permanent order i.n said action until <br />further order of Court. <br />NOW, `i'fi~'REFORE, BE IT rtESOLVED by the Council of the City of North Olmsted, <br />State of Ohio: <br />Section is That the Solicitor be authorized to sign a Journal Entry in the <br />action brought by Mildred Knapik against the City of North Olmsted, making it mandatory <br />that the city bury and cover all rubbish, waste and refuse daily with at least two <br />feet oz' earth in the sanitary land fill operated by said city. <br />Section 2: That this resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of tine public peace, safety and welfare of the <br />City of North Olmsted, and such emergency exists by virtue of the necessity of making <br />a final entry in the action pending in the Court of Common Pleas as case No. 67810:1, <br />Mildred Knapik, et al, vs. City of North Olmsted, et al, so as to dispose of said ,action. <br />Section 3: Wherefore, this resolution shall take immediate ef'ect from :anal <br />after its passage, otherwise, at the earliest period allowed by law. <br />Passed: ~ S ,i ~ 9, <br />ATTr~STs ~ , <br />CLERK OF COUNCIL <br />APPROVE ;' <br />~ \ 9 j <br />~. <br />MA 0 <br />s <br />`IDENT UF' UNCIL <br />,y .w.:,..-s....-..~-,...-,~.-.:.,....~... ..y , ,.,. ... <br />
