Brown ~c Associates, in the proposed plan, indicated <br />the tract of land belonging to the Fars{ :Board as post desirably located for <br />such a system, and <br />"v''dEItEAS, negotiations zaitYl the Fark Board for the acquisition of said <br />tract through appropriation proceedings heretofore filed b*y the City, at which <br />time the Park L'oard agreed t;o dispose of said tract to the City of north 01~nsted, <br />for the consideration of ~~our Thousand Dollars (;x.,000.00), under certain terms <br />and conditions which have been reduced to a Memorandum of Agreement ~.,nd ~~rhich <br />the Council has reviewed and found the suggested terms and cond~:tions for the use <br />of said. tract b~.r the City for the purposes indicated, as fair a.nd reasonable and <br />within the power of the ~~ity in the operation of its sewage treatment system to <br />comply with. <br />r~10~~J, TI~'~FOI-~ , 3~ I" O~.D~II~FD by the Council off' i,he City of North CL~stpd, <br />State of Ohio: <br />Section l: T'riat the P•Ia; or, Clerk of Council and Direc~,,or of Public Service <br />be authorized to enter into an agreement with the Park Board in connection ti~rith <br />the acquisition of a tract of land presently owned by the Park Board, by the City <br />of North Olmsted for the proposed site of a sewage treatment plant, apart of <br />the City~s proposed sewage treatment system, which agreement places limitations, <br />terms and conditions or. the use oP said tract bar the City, while used for seT~ra;~;e ~~ <br />treatment plant. <br />Section 2: That the terms and conditions of the use of said tract for n <br />sewage treatment plant by the City of North Olmsted as a part of its sewage <br />treatment system, are fair and reasonable and within thy po?~rer of the City <br />to comply ~:rith. <br />Section 3: ~~rierefore, this Ordinance is hereby declared to be an <br />emergency measure necessary for. the immediate preservation. of the public health, <br />peace and welfare of the City of Forth Olmsted and such emerger.:cy exists by virtue <br />of the r_ecessity of expediting the acquisition of a site for the sewage treatment <br />plant i.n the orderly process of designing a sewage treatment s~Tstem for the "it;* <br />of North 01msted, <br />Section ~~: L~herefore, this Ordinance shall tales immediate effect from and <br />after its passage, otheru,*~.se, at the earliest per' od allotaed y law. <br />Passed: ,~J" ~ q,_~ •. <br />,~ _ PRES ~ T ~ L.
