CITY OF NORTH OLMSTED ORDINANCE N0. .~Ca.~.~l AN ORDINANCE AUTHORIZING AND DIRECTING THE CANCELLATION OF' SPECIAL ASS-r;SSMENTS ON PF.~MAIV'L'NTT PARCEL N0. 232-g-10 ON PORTER ROAD WATER MAIN #1; PERMANENT PARCELS NO. 235-12-I00 AND 235-12-101 ON DECKER ROAD '~/ATER MAIN ~I, ALL IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EME~G:r,NCY. ~' ~ ,Anthony Axcara has paid assessments, together-with accrued interest thereon, levied against Permanent Parcel No. 232-9-10 on Porter Road Water Main ~l, and George and Mary Mitzo have paid assessments, together with accrued interest thereon, levied against Permanent Parcels No. 235-12-100 and 235-I2-101 on Decker Road Water Main #~l, a.11 in the City of North Olmsted, Ohio, of Ohio: NOW', THEREF~?RE, BE IT ORDAINED by the Council of the City of North Olmsted, State Section 1: That the Auditor of Cuyahoga County be and he is hereby authorized and directed to cancel all future assessments~begin~ with the year 1952 through 1861 inclusive, which have been certified and levied on Permanent Parcel No. 232-9-10 on Porter Road in the City of North Olmsted which assessments have been certified and levied for the improvement of Porter Road by constructing therein a water main, known as Water Main ~l` . Section 2: That the Treasurer of the City of North Olmsted is hereby authorized and directed to receive payment 3n full, with interest on such assessments beginning with the year 1952 through 1861 inclusive, which principal and interest amounts to the sum of Three Hundred Thirty-Three and 84100 Dollars ($333.84}, on said Permanent Parcel No. 232-g-10 on Porter Road for the improvement of said Porter Road by constructing therein a water main, known as Water Main ~1. Section 3: That the Auditor of Cuyahoga County be and he is hereby authorized and directed to cancel all future assessments, beginning with the year 1955 through 1964 inclusive, which have been certified and levied on Permanent Parcels No. 235-12-100 and 235-12-101 on Decker Road, which assessments have been certified and levied for the improve- ment of Decker Road by constructing therein a water main, known as Water Main #I. Section 4: That the Treasurer of the City of North Olmsted is hereb~r authorized and directed to receive payment in full, with interest on such assessments beginning with the year 1955 through 1864 inclusive, which principal and. interest amounts to the sum of Three Hundred Twenty-Eight and 68100 Dollars {$328.68), on said Permanent Parcels No. 235-12-1U0 and 235-12-101 on Decker Road for the improvement of said Decker Road by con- structingttierein a water main, known as Water Main ~l. Section 5: That the Clerk is hereby directed to forward an attested copy of this ordinance as to each permanent parcel number referred to herein to the Auditor of Cuyahoga County, Ohio. Section 6: Wherefore, this ardinance is declared to be an emergency measure necessary for the immediate preservation of the public peace and welfare of the City of North Olmsted, and such emergency exists by virtue of the need for the immediate cancellation of special assessments on Permanent Parcel No. 232-g-10 on Porter Road for the improvement of Porter Road by constructing therein a water main, known as tJater Main #1, and on t~erman- ent Parcels No. 235-12-100 and 235-12-101 on Decker Road for the improvement of Decker 8oad by constructing therein a water main, known as Water Main ~1, as the owners of said permanent parcel numbers referred to herein have requested to pay up the amount of said assessments, with interest thereon, in full, and they have paid the same in full.
